  • I visited the retail park today and have noticed there is a sign at the entrance mentioning Car Park terms (they issued me with the invoice in Feb 2019) so at that time there could have been inadequate signs. 

    However, if I drive straight into the car park and park my vehicle next to Wren there is no noticeable signs, so I can argue I did not see the signage? 
  • Wren have also confirmed that they changed the parking times from 4 hours to 3 hours, but this doesn't help me as I am alleged to have parked for 4hrs 20 mins.
  • Here are the pictures I took at Wren, my argument is that it's not that difficult to miss the signage.

    Just received a call from Wren and they have agreed to write a cheque out to me for £302, which is for the full amount of the fine.

    Should i still contest or pay up?

    I really hope the OP does just that...I'm not holding my breath though.

    Wrens paid up because the OP probably spent thousands on a new kitchen, but the scammers still got paid. 

    Why didn't Wrens just insist the invoice was cancelled?

    This is not a good result at all unless the OP defends the claim IMHO.

    The defendant visited Wren Kitchen on 19 Feb 2019 to view / buy a kitchen.  The design process at Wren Kitchens took a long time. At no point was the defendant aware of any parking restrictions. Upon visiting the retail park the defendant didn’t notice any signs of any parking restrictions. The defendant has taken pictures which show no signs are noticeable when entering the retail park and parking outside Wren Kitchens (see below).

    The defendant did not receive the original correspondence from UK Parking Control as this was issued to the previous address. Upon receiving the follow up letter, The defendant asked UK Parking Control if they can prove any breach of their terms. The defendant received images of entering the retail park and exiting the retail park with a time and date stamp, however no “actual” evidence was supplied to conclusively prove that the defendant had “overstayed”.

    The defendant also queried the matter with Wren kitchens who were also surprised the defendant received an invoice from UK Parking Control for any breach of terms and Wren kitchens assured the defendant this matter would be resolved. The defendant did receive follow up correspondence from UK Parking Control and DCB Legal but since the matter was being dealt by Wren Kitchens the defendant did not respond to either party.

    DCB Legal are now asking the defendant to pay an inflated amount of £302, but UK Parking Control Ltd are yet to prove that any breach of terms has taken place.
