FYI

D1 - 1 Do you consider that this claim is suitable for determination without a hearing, i.e. by a judge reading and considering the case papers, witness statements and other documents filed by the parties, making a decision, and giving a note of reasons for that decision?

E5 - Do you believe you, or a witness who will give evidence on your behalf, are vulnerable in any way which the court needs to consider? If Yes, please explain in what way you or the witness are vulnerable and what steps, support or adjustments you wish the court and the judge to consider.

    Obviously NO to a hearing on the papers.  What to say about this (your reason for saying NO) is fully explained in the Telephone Hearings thread.

    However, some areas won't have a choice.

    Obviously on the immediate short term, if your local court is a pilot area you could try to select another if one is nearby.

    If say you worked in Newport but lived in Cardiff, the former could, arguably, be a convenient choice, for example.

    The pilot defendants will need to be guided differently, with far better paperwork, such as a skeleton argument with authorities, separate from a proper 'story and picture exhibits only' WS.

    Some rookie Judges are going to just believe every word of a roboclaim template WS and be easily impressed by the claimant.

    One thing i will add is that there is always an advantage of having a physical f2f hearing rather then a telephone/phone hearing
    So there are various reasons you can give as to why you need a f2f hearing rather then any other type

    Manchester would be the only court where I'd have any degree of confidence in them dealing with a private parking case in an informed way.
