NCP letter

Hi,

I saw a letter from NCP for London gatwick dropped off, I went abroad on the 10th this month didn’t receive any letter before then  I came back on the 20th that’s when I saw the letter. I tried to appeal it using the newbies temple but it’s not coming up at all. The date of the incident was on the end of august last year and the photo shows me driving lol. What’s the best way to deal with this

    Respond once, saying the signage at Gatwick is appalling and you've added your case to complaint ref BPA-032489.

    Add this:

    I am aware that Sara Roberts, Head of AOS at the BPA is already investigating a formal complaint about your sneaky little set up at Gatwick Airport, which breaches the BPA CoP regarding lack of grace periods, methods of payment if the unknown £5 and signage (if seen by a driver) that only refers to £5 not £100.  No contract was formed.


    Also complain to Gatwick Airport.  They can normally get it reduced to £15.

    And email Sara Roberts quoting the above BPA complaint ref:

    [email protected]

    Appeal against Parking Charge Notice (PCN) no. LGXXXXXX


    I dispute your 'parking charge', as the registered keeper of the vehicle. I deny any liability or contractual agreement and I will be making a complaint about your conduct to your client landowner, Gatwick Airport Ltd, as well as to the local MP.


    I contest and appeal this ‘parking charge’, on the grounds that:


    The drop off area appears to be not relevant land as defined by paragraph 3 of Schedule 4 of The Protection Of Freedoms Act 2012, as an Airport and being subject to byelaws. NCP cannot, therefore transfer liability for the alleged charge from the driver at the time to me, the keeper.

    and

    NCP have failed to comply with Schedule 4 of the Protection of Freedoms Act 2012; the issue date of your PCN was 107 days later than the day after which the specified period of parking ended, and not within 14 days as required in paragraph 9 of the aforementioned Act. Therefore, keeper liability does not apply. There will be no admissions as to who was driving, and no assumptions can be drawn.


    There is no legal requirement for the registered keeper to name the driver at the time and I will not be doing so.


    Further to the above I am aware that Sara Roberts, Head of AOS at the BPA is already investigating a formal complaint ref:BPA-032489 about your set up at Gatwick Airport, which breaches the BPA CoP and in this instance your appalling signage and no method for people to actually pay before leaving if they do use the drop-off area.


    I would suggest that you cancel the PCN as you have precisely no hope with POPLA where the driver is unidentified and the breach of POFA noted above, I will complain to the BPA and to the DVLA for a possible breach of KADOE and I shall most certainly add my case to BPA-032489 too should you proceed.



    I do not expect to hear from you again, except to confirm that no further action will be taken on this matter and my personal details have been removed from your records

    No, it isn't an 'appeal'.  You are too late to appeal.
