Your MA is clearly in trouble. What on earth was your MA thinking, taking on a notorious residential parking scammer, did they not do their homework first or were they enticed by money ?
I would appeal to UKCPM which they will reject anyway, you need a paper trail from these money scammers
And for your interest, if it does end up in court, most judges will understand the rights you have as a resident4 -
Thanks guys, thankfully we are fairing ok, both had COVID a few times now and both already dealing with long COVID symptoms along with other chronic conditions so as you can imagine we are both delighted to be having to waste our time dealing with this ridiculous and stressful situation. I will be sure to highlight this in our letter to our MP 😀
I have repeatedly asked the MA to provide evidence of the procedure they followed when introducing the enforcement scheme, so far nothing to suggest it follows all the laws and rules etc you have all so helpfully provided.
The current member of staff assigned to us has been in post less than a year and does not seem to be able to provide any convincing evidence or authority on the matter so I would assume the MA has failed at pretty much every step.
I will get on to the council. Never had to deal with planning before, is this something that needs to be done in writing or can be done via email or some sort of online planning portal these days?
Apologies again for all the questions, long COVID has definitely affected us mentally with brain fog so it is struggle to get up to speed with everything as there is so much to read on these matters and expert knowledge on offer. We appreciate the support massively. I hope if we are successful in our fight that we can contribute back to this community in the future.

I feel your pain! I have been in the same situation - freeholder on mixed freehold and leasehold estate. I got parking tickets for parking lawfully in my own space after I had opted the space out of the permit scheme in writing. The parking tickets were all cancelled. The police have recorded it as harassment. The parking company was eventually fired. The management company took action when they realised their legal and financial liabilities.
You should make sure that the management company understand that they are jointly and severally liable for any law breaking by the parking company. You could ask them what steps they are taking to ensure that the parking company is complying with data protection and other laws.
Also make sure that they (and other residents) understand the potential financial repercussions. If the management company is sued, residents will end up paying through their service charge/estate charge. There may also be a clause in the contract allowing the parking company to reclaim any costs incurred from residents. You need to find out what's in that contract!9 -

The contract disclosed by PPS to us included:
12. The Client will indemnify the Company against claims that arise out of disputes over ownership of the land on which the Client has instructed the Company to act.

Who are Managing Agents ? mainly Estate Agents who don't know how to manage and have staff, probably ex failed double glazing salesmen.
For an MA to get out of a scammers contract will cost a lot which could bankrupt them
So many so called MA's are complete fools

Are the freeholders shareholders in a management company? That company being the managing agent.
If not who appoints the management agent? Can they be dismissed?
I was asked to be a management agent last year by a client living in a block of flats. Turned that down very quickly, I knew one of the residents was a complete PITA. Threatening to sue everyone left right and centre she was, no thanks.
