  • An update for those that may be following my case. 
    I received two letters in relatively quick succession. Both arrived by post last week
    1. Notice of Allocation to the small claims track (hearing)
    2. Notice of trial date

    #1 states that I need to provide the court and claimant with a witness statement and "all other documents" no later than 14 days before the hearing.

    A few questions on this please:
    - does this need to be sent to the same email addresses as those I used for the Directions Questionnaire?
    - my hearing is not for another 5 months. Is there any advice on when I should be submitting these? I am thinking as close to the 14 days as it will allow me to refine my witness statement
    - by "all other documents" are they referring to photos of signage and such like?
     
    A few questions on letter #2
    - it states that I will receive confirmation of the hearing by 4pm, two days before the hearing. Does this come through the post? I've never received any comms form them via the phone or email yet
    - I have included my wife as an attendee on one of the earlier forms. Does that mean she can speak on my behalf at the hearing too?

    Unless anything comes out of your response to the above, my plan now is to work on the witness statement and get this in at the appropriate time. I guess I then sit back and wait as the claimant may decide to pull out? A few of the posts have indicated that this is not uncommon.

    Your wife can speak as your lay representative (search the forum).

    Of course nothing gets sent to the Northampton CCBC email address now, eek, that would mean it would be in a massive call centre black hole!  They haven't been involved for months and were just a gateway admin centre right at the start.

    You are dealing with your local court - and copy in the Claimant's solicitors.

    Do NOT use the Robert Cox WS bundle example in the NEWBIES thread. It is out of date.

    A couple of questions, as I turn my attention to preparing the witness statement:

    - my court date is in early July and my witness statement needs to be submitted at least 14 days prior to this. Having reviewed the very helpful thread by @Umkomaas on DCB discontinuances, there seems to be a lot of people suggesting that this has been issued around this 14 days mark and in many instances before the WS has been submitted. Hence, does it make sense to submit the WS close to this time and not a month in advance?

    - secondly, all the cases in the above thread have resulted in discontinuances. Are there any examples of DCB cases that have gone to court as I would like to know and be prepared for how these pan out?

    I would not send the WS very early in advance.

    Nor would I work on it until June because by that time, you will have seen the final Draft Impact Assessment and new Code of Practice and the landscape PPCs operate on will be shifting significantly.  I suspect there will be Ministers' words worth quoting plus the Code itself will give Judges a steer.  Your WS will hopefully benefit from waiting to see what the DLUHC say.

    Please stick around, so you don't miss the upcoming Draft Impact Assessment and Public Consultation, that we need hundreds of real victims to respond to this Spring.

    It will be all over this forum any week now and you'll miss your opportunity to make the Government hear your individual voice, if you don't come back here till June.

    As you suggest, will begin the WS early June and disregard the WS template I downloaded recently, since the arguments and policy may shift and presumably there will be a more suitable WS available in June.

    Maybe a letter of discontinuance will slide through the door before then…

    And today...
    Dated 1 June 2023 is my letter of discontinuance. The letter came with a copy of the claimants "Notice of Discontinuance". and it specifies that this applies to all of the claim. They have said the file is now being closed. I assume no further actions are required? I was wondering if I will see anything on MCOL.
    My hearing was set for 6 July and I hadn't yet submitted my witness statement. 

    Massive thanks to everyone that has helped me on here. Please let me know if you require any info on the above.

    We need you - as a genuine PPC victim of aggression, sharp practice and an 'extortion' attempt to add £70 - to respond robustly to the Public Consultation on the level of parking charges and banning of the false added DRA 'fee' that too many honest motorists currently fall victim to.
