  • 16 November and no contact from the claimant or the courts...
    I have checked MCOL and the last activity on there is the receipt of my defense.

    You mentioned on 3 November at 2:49PM that the CCBC sent you a letter.
    That letter said the Claimant has twenty eight days to consider your Defence.
    What you don't know is when the CCBC sent a copy of your Defence to the Claimant. 
    It follows from that that it is not known when the Claimant has to respond to the CCBC. 
    Further, we don't know what delays there are in the CCBC that means they don't send you a Directions Questionnaire as promptly as you might like.
    Can I suggest that you keep checking your MCOL Claim History and as soon as you see that the CCBC has sent a DQ to you, you are ready to download a DQ, complete it and fire it back to the CCBC, remembering to send a copy to the Claimant of course?

    Yes, there could have been a delay to get my defence to the claimant and there may be further delays at MCOL but how and when do I know whether there will be some further action or not? We are now at day 30 since receiving the aforementioned letter.

    One of the people that I am helping had that letter in late March/early April and finally got the N 180 in October
    The pen is mightier than the sword ..... and I have many pens.

    The letter from the CCBC tells you the Claimant has 28 days to respond. Have you allowed five days for service of the Defence on the Claimant?

    So, 24th October + five days for Service + 28 days for the Claimant to respond to the CCBC means the CCBC should receive a response from the Claimant by Monday 28th November.
    We are not even there yet - and that assumes the CCBC really did send your Defence to the Claimant on 24th October.

    Please re-read my earlier post which you have just quoted.

    And as I said earlier, even if the Claimant fails to respond by the due date, the CCBC will write to them giving them another seven days.

    You are really wasting your time worrying about this non-issue.

    Never been involved in this court malarkey and just a bit daunted by the whole experience. 
    Given that it could potentially take months before I receive a response, I suppose I should check on MCOL periodically in case I miss a letter.

    I will refer to the Newbies forum on how I should complete this and will post any questions on here.

    One for now, the cover letter offers the opportunity to discuss a settlement over the phone. Is this advisable? What tack to people take and will this help or hinder any court proceedings?

    No one advises talking to them.  It would be a 'Without Prejudice, Save as to Costs' discussion, so could never be discussed during court proceedings in any way that could influence the judge to find for or against you. 

    Keep playing the straight bat and edge them nearer the discontinuation precipice!

    No, that is not your Directions Questionnaire.
    Read the covering letter again. It is a copy of the Claimant's DQ that DCBLegal have filed with the County Court Business Centre.

    Wait for your DQ direct from the CCBC.

    Never ever phone the Claimant or their solicitors.
