    It can be emailed. As well as to the court, 'Serve copies to all other parties' means to the Claimant's solicitors. For the sake of an extra email address in the address line, send a copy to the PPC as well, gives them something extra to do!

    Please re-read the first 12 steps in the first post of the Template Defence thread.

    Those steps include this standard stage and are designed to stop people having to ask/worry about the DQ N180. It answers your questions.

    Then re-read the section in the 2nd post of the NEWBIES thread that is headed in red capitals to grab all new posters' attention:

    IMPORTANT: KNOW WHAT HAPPENS WHEN

    That tells you when to expect the other side's WS & evidence photos and what you need to do: when and how and to whom. There's a link to a 'court process' thread by bargepole that walks you through it.

    Getting a SAR is also in that post (but obviously you can't also ask the solicitor to put the case 'on hold' at live court claim stage, so don't do that!).

  • Hi all, my son has now received witness statement from the claimant. 
    When we asked for all photographs from them they held of my sons car, they only sent two.. both are within a minute of each other .. one when he was pulling in and the other when he was parked. 
    They have now Filed 7 (photographs one of him overstaying by 18  mins]
    Also on the original parking fine that has been filed the two photos they have sent are one pulling in to the space and one parked straight after .. but not the one where he has overstayed. Can this still be classed as a legit parking notice?

    Have you done your WS bundle & evidence yet?  You know you have to because the hearing letter tells you and so does the NEWBIES thread.  It clearly says DEFENCE IS NOT YOUR ONLY JOB.

    This stage is not a surprise; parties in a dispute don't just rock up to a court hearing with no WS or evidence!

    Their photos are normal stuff, with a template statement seen & discussed here hundreds of times.

    See the thread about his WS bundle, by @aphex007 and adapt it to suit.

  • I understand we have to do the witness statement we are doing them now … I am confused as to why the the parking fine photographs are one minute apart, and the one that shows him going over the time is not on the original parking fine

    I think the Defendant can legitimately state in the WS that he feels somewhat ambushed by new evidence neither pleaded in the Particulars of Claim nor shown on the original PCN, nor disclosed before litigation.  The Claimant had a duty under the pre-action protocol to show the photo evidence and they did not.  The Defendant was only shown two photos, one minute apart.  Until suddenly ambushed by the Claimant in their Witness Statement with more photographs.

    The Judge may not care but mention it.

    However, that is NOT a defence point against the PCN so not a big issue.  Your son's original defence is what he must expand upon (unclear signage or what?).

    What's his deadline...is he late already?

  • Yes one sign high up and Also the car park didn’t have the pick up /drop off time limit when it first opened. So he didn’t Evan look for signs because he had visited the car park many times before. The sign also blends in with advertising very nearby.
