Cazzy1964 said:What about the cctv or photographs? Not sure how we create a defence as he can’t remember any details about it. Their asking for £292 the original parking ticket was £100
The defendant will get the SAR reply soon, and certainly in time for witness statement and evidence stage (before the hearing) which is good enough.
If the SAR comes back before 9th Sept then great, it will help focus the facts a bit but if not, then this is what the Template Defence is for. The added paragraph 3 is as much about what the Defendant DOES NOT know as also about what he does recall. Easy stuff!

Sorry trading as park watch0

OK, standard clueless ex-clamper. Advice remains the same and make sure everything is done in the Defendant's name, not yours.
Maybe wait one week in case the SAR reply (assuming he's asked Parkwatch for a SAR?) comes through and if not then your son just adapts the Template Defence and puts what he does and DOES NOT know (cannot admit or deny) in para 3.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Yes we have requested the SAR from parkwatch.thanks for all your comments.
is it enough on the part explain in your own words. To put that he does recall getting one parking ticket a few years ago but forgotten about it?0 -
He'd be adding more. Whatever he can recall: why he was there; what went wrong/why a PCN was issued; what sort of car park it was; that he was an authorised patron because...and whether he appealed or complained to the landowner. Plus if he cannot recall much he should say so and state that no information nor even a photo of the alleged contract on the sign has yet been supplied and he is having to defend 'blind' at this point.PRIVATE 'PCN'? Thank you .. Also, not sure how they got his number but he got a text in April from Gladstone solicitors saying,
£170 due as you have not responded to our pre action letter.. click on the link. He thought it was a scam0 -
They (correctly) did a 'soft trace' to check his address and any contact details held on his credit file. A soft trace is allowed and leaves no footprint.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Would it be ok if I tell you what I’ve put, to see if this is enough?0

What was the name of the car park/location as we could well have already had previous cases about it? ParkWatch have a number of sites with 'forbidding' signs which means they may have difficulty in arguing that any kind of contract was formed. Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .
I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.
