The stats from the MoJ show that only around 10-12% of claims issued in all types of cases, are defended, including parking claims.

So, for the likes of DCB Legal, BW Legal and the rest of the motley crew, it's a numbers game. For every case that they discontinue, or lose at a Court hearing, there will be 8 or 9 others in which the Defendant was scared into paying up, or didn't respond and received a default CCJ.

As said previously, we only see the tip of the iceberg on this forum, and there are multiple parking cases listed at various Courts daily which we know nothing about. I was sitting in a Court waiting room recently with my client, and a guy turned up for a parking case hearing before a different Judge. He had literally no paperwork at all with him, while the Claimant's rep was sitting there with a folder containing all the documents. Lamb to the slaughter, I suspect.
    Dont judge so hastily :)
I never use paper work in court hearings I litterally do everything on my tablet. I find it the easiest way to search for sections of documents. Case law references and CPR stuff etc etc

This Defendant didn't have a laptop or any other device with him. Or a jacket and tie. He didn't even know the name of the Claimant when asked by the Usher, all he could say was 'I'm here for a parking fine'. Utterly clueless.

Re: Paperwork, I also use a laptop for most things, but it's always handy to have paper copies of the documents, in case the other side or the Court hasn't got a copy in their file.

I have been providing assistance, including Lay Representation at Court hearings (current score: won 57, lost 14), to defendants in parking cases for over 5 years. I have an LLB (Hons) degree, and have a Graduate Diploma in Civil Litigation from CILEx. However, any advice given on these forums by me is NOT formal legal advice, and I accept no liability for its accuracy.

.. and as we know, several PPC and/or their solicitors always claim never to have received the defendant's witness statement!
  • Hi @Umkomaas,

Just here to add my case to the list of discontinuations from DCBLegal:

    51 ... and counting! 😊
Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

That works out at 1.0408 (to 4 decimal places) discontinuations per calendar day :)
  • The BIG question is .. how many do DCBL actually discontinue outside of this forum.
Many people who do not post here will still read what to do

As this forum and MSE are top of the pops on google, I would suggest the number is high simply because the majority of cases they ROBO CLAIM are rubbish.

    51 and counting .....
