Hi, I haven't receive the first instalment of cost of living payment as I got nil award for the period of the 8th of April till 7th of May. I'm earning every 4 weeks and that's the reason for my nil award. I got UC from 8th of May til 7th of June tho.
It seems so unfair and I would really like to challenge that but I don't know how. I have already filled the appeal form but they keep saying the same thing about the nil award as a reason.

There is nothing to appeal. The regulations are very simple and by virtue of your nil entitlement on that date you are not qualified for that first payment. The only issue you can do is raise your concerns with your MP but it is extremely unlikely anything will change. Thank you for your answer. So even if I have been awarded from 7th of May so within the qualifying period I'm still not eligible? At this point I feel like I would even like to take to the court because it's so unfair. I'm single parent , working part time and just because I'm getting paid every four weeks makes me loose out. They saying so much about equality and doing complete opposite. Computer decides. How come the person who get exact the same annual income as me but getting paid once a month gets the help with no problem and I don't. It's just so unfair and should be illegal. If you had been received a payment for the assessment period ending on 7th May you would have got the first Cost of Living payment. It seems your wage got counted twice in the assessment period because you get paid every 4 weeks. I've read on here somewhere that UC may be able to do something for you, however i can't recall what it was. You should talk to them.So even if I have been awarded from 7th of May so within the qualifying period I'm still not eligible? .... I'm single parent , working part time and just because I'm getting paid every four weeks makes me loose out.
The rules are they count all income in the monthly assessment period but there may be exceptions for your situation as lots of other people will be in the same position and hence losing out.1 -

Can kasia3992 not say that "both payments had to be taken into account in the one assessment period was so irrational as to be unlawful"? I know it's for monthly payments but the same principal can apply ....poppy12345 said:

If she's paid every 4 weeks and there's a UC deduction this will be happening several times a year .....0 -
