Potentially lethal failure

Hello I need some advice. My wife recently purchased a new car which took 8 months to arrive. She was driving on a smart motorway at speed when the engine turned itself off and she had a message came up saying press the start/stop button. The car was only 11 days old. The manufacturers have had the car now for 28 days and cannot diagnose the fault. We have rejected the car which is in finance as I don’t want her to drive the car again. The incident could have been lethal and my wife has been suffering from stress since it happened. What’s our rights and what should be our course of action

    What have the manufacturer and finance company said about a replacement now you have rejected the vehicle ?

    Have they both accepted the rejection ?

    If they cannot replace it then you are entitled to a full refund, nothing more.

    What car/make/model/etc please.
    Additionally who was in the car and did anyone move or touch the remote key?
    Did their diagnosis machine ID the switch off?

    Did you  touch the star/stop button?  (NB people did especially in car new to them)

    Most cars do however come with a safety switch built in that wont let you accidentally turn off above x speed.

    This does sound rather like an accidental hit on the start stop button something I once did in my previous car (golf GTE) Easy to do in car you are just getting used too.

    It seems a bit of a flaw that the start/stop button will stop the car when it's moving.

    at higher speeds.
    Op is not back, most likely resolved it.

    If it does then a major flaw that should not happen with a quick push as it should be inhibited above a certain speed but a push and hold could stop the engine in the case of engine run away.


  • You cannot stop my last two Toyotas by accident, it takes a conscious effort to do so.

    This is the emergency stop procedure for a Yaris and Aygo with keyless start.

    I'd a Golf a number of years back that did that.  One year old.  Was diagnosed as a fault in the upper wiring loom which they replaced and it cured it.

    Very disconcerting when it happens.  Happened once when i was overtaking someone.
  • My wife was the only person in the car. The diagnostics showed that the engine stopped and that the message came on the screen to restart the car at a speed between 60&70 miles an hour. The technician downloaded the info. He couldn’t understand it as if a problem it shown there should also be a remedial action. There was none which baffled the technician he said he’d never seen anything like it. The finance company say deal with the dealership. I’m not naming the manufacturer at this time. The start stop button was not pressed to cause the engine to turn off, Thai was confirmed by the diagnostics. I really need to find a solicitor who deals with things like this.
