    Oooh we need to read that Appeal Judgment.  Wonder if we can get hold of it because a judgment by Her Honour Judge Evans is persuasive (alongside CEL v Chan).

    I wonder if this is HHJ Claire Evans, sitting in the Manchester County Court?

    Don't agree, but at least the ex-clampers had to cover their own four figure costs.  What a waste of time & money.  Disproportionate garbage case IMHO.

    Talking of common sense outcomes, the in the appeal case at the Manchester court (achieved by someone they know pretty well...) linked yesterday on this very thread must have royally peed off BW Legal and chums.

    Why can't parking roboclaimers plead cases properly?

  • The Welsh language judgment will silence all the nonsense appeals/challenges based on that argument in Wales now, so the legal fees will be worth it.

    Maybe Claimants would give a more detailed POC if the courts increased the character limit on the claim form as it’s currently very limited. 
    It’s a BS technically though, as by this point the motorist would be fully aware of what the claim relates to; it’s not as if it’s the first contact that they have received.

    If these judgments mean that operators will need to start sending separate detailed POC (increasing operating costs), that would be another justification for not reducing the charge level / removing the escalation fee as it helps demonstrate that low levels are not commercially viable.

    It’s interesting that all the signage in the car park is in both Welsh and English.

    The pay and display machine is still faulty as of 4th May and there is no mobile phone signal to pay using an app. So the wifi hotspot is the only option.

    I hope you are correct but is that certain? According to the opening sentence in the linked article, the judge "has allowed parking company One Parking Solution to claim costs". She also allowed the £70 fake add on fee.
