Treat it as a proper LBC and respond robustly, stating what you need to see to 'narrow the issues':
- photos of signs?
- The harbour byelaws?
- Evidence that Smart have as to who was driving, given they don't use the POFA 2012 and can't hold registered keepers liable?
- the missing NTK you never received?
ALSO reconfirm your correct address for service and that any previous address that Smart held MUST NOT be used and MUST be erased from the databases of CST and their client.
PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Thanks coupon mad...I guess this is my job for tomorrow.
Is this a serious issue or is there a good chance that it can be solved without too much financial loss?0 -
Much the same as other CST 'frightener' LBCs we've been asked for advice on.Please read this:
https://forums.moneysavingexpert.com/discussion/6166004/cst-letters-forum-group-thread/p1As well as following @Coupon-mad's advice above. Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .
I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

Ok - I have sent the two emails, one to CST LAW and the other to Smart parking regarding the SAR.
Lets see what happens....1 -
Obviously it's too early to say I've no reply yet from either email I sent yesterday; however, I am wondering what would be the case if AFTER the 30 day deadline is up from CST law what will happen IF I still haven't heard from them. I'm obviously just a little worried about potentially going to court over something as stupid as a bloody parking ticket!

Why are you worried
this isnt a real LBC, you wont get a court claim
I already advised you yesterday it wont lead to a court claim
your not going to hear back from CST
Forget this now1
