Parking Fine - Unsure what steps to take first smart parking/DPR Letter

    Slight update... 

    Coincidentally, a few days after I posted the above smart got in touch with me regarding the SAR.

    I'm still no further, they replied simply saying I've sent them evidence of the wrong address. e.g., evidemce with my NEW address on (the original PCN was sent to my old address, which was part of the original problem) 

    In response to this I just forwarded them the data rectification notice email I sent the 13th May this year, in which I asked them to delete my old address and update iy to my new one. It doesn't sound like they've done this if that email is anything to.go by, maybe?

    Anyway, now its another wait for a reply...

  • I am going to send an email to the ICO today. 

    I still haven't heard anything from smart. I need to check actually when I sent the email for the SAR, or does the clock start again after their none-answer...?

    Given the radio silence from Smart Parking, I am wondering if they've cancelled your PCN. You can check the status of the charge by logging into their website as if you are going to pay it (obviously don't!) and see what it says. 
    Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

  • That sounds too good to be true! But I will check today and let you know! 
  • I have checked today and the PCN still seems to be active. I can still pay, which I obviously haven't. 

    Still no reply to the email I sent with the attachment email from the 13th May as extra proof of my old and new addresses. I still  haven't had a chance to report them to the ICO yet. 

    I think the 30 days notice is up for any sort of reply. I need to check when I sent them my original SAR request email.

    The ICO will expect that firstly the 30 days have actually (not practically) expired, then a reminder is sent, giving them a further 7 days to respond fully, threatening with a report to theICO if they fail. 

    Pity the PCN is still showing as live, but worth checking out nonetheless.
