Yeah I know you're right. It's just the way these letters get you.

One day I will hopefully be able to write all the steps down I took for someone else to know what to do. Probably not for a other five years like, since this is how long they have to reclaim their so called debt!

Six years. Unless you are in Scotland?  It is 6 years in E&W.

Better to use your energy to respond to the upcoming Public Consultation and let the Government hear your wrath.  Do that instead of fretting about CST and what they may or may not do.  We do understand your position though, and we know your voice will be powerful evidence so please join us for this:

We trust after reading around a bit on this forum, that you are aware that the statutory Code of Practice (that will regulate the PPCs and DRAs - both of them) is temporarily stalled?

And that we are calling on ALL victims to help...

We sincerely hope that you are au fait with the need to respond to the final Government Public Consultation to join our push to get it over the line. Hopefully - amongst all the political disruption - it will be open later this year and into January.

If PPCs manage to turn around the decision on banning the gaslighting / claim-funding 'fees' then the DLUHC will be rubber-stamping £200 parking charges and if that happens, they (Government) and the PPCs will wreck high streets and people's lives.  Whoever is responsible, if that happens (and it very nearly did in 2021) must hang their heads in shame.

Just checking you are among those ready to respond to the questions as you have personal experience of how this crap of £170 eye-watering demands actually feels?

Please come back here when it opens, and you can make sure you don't miss the Consultation:

If you are not likely to be a regular reader in the coming weeks/into 2023, to be alerted you'll need to bookmark the thread by MSE_JC at the top of the forum and enable (on your profile) email alerts for bookmarked threads.  That thread explains the background, in my reply there earlier this year (PLEASE READ IT).

This will be your only chance to influence the law.

I've, as of yet, ibe not received a reply to my request for a SAR from Smart Parking or anything from cst law.  I'm asking, as a matter of interest, if that's normal? I would have thought I would have received the SAR from Smart Parking at least. I'm wondering whether to send another email as the '30 days letter before claim notice' will soon be coming to an end.

But you only made your SAR 16 days ago, they have 30 days to respond. It might be at the top of your priority list, but it won't be at the top of Smart's.

What are you expecting from CST?  They won't be writing to confirm a 30-day hold.
Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

  • Yeah all very true...I will just leave it like you've both said. Its just one of those things where you try and think of every eventuality incase they get you in something you didn't think of.

Meh...that's the problem with being a worrier.

    Thanks again!

NO, you don't let it go, POOR ADVICE ..... Smart must comply with THE law.   if they fail to  respond within the 30 day time period, you report Smart to the ICO

All true - but also there's another 2 weeks before that status arrives, so NOW is not the time to go firing guns. ;)

  • Now I'm hoping they don't respond within 30 days so I can send that email to the ioc!

    Both pieces of advice noted!

    Thank you
