PCN for double dipping without stopping

Hi all, 


I hope that you can help me with this issue, as I have wrongly received a PCN, despite not stopping in the car park but I did enter it twice in the same evening, I believe this is known as 'double-dipping'.

This issue is causing me lots of undue distress and worry, as I have done nothing wrong; I did not park, stop the vehicle or leave it unattended at any point, I in essence turned the vehicle around from the direction I was originally travelling in and exited the site by driving straight through it. 

There is either a fault in the ANPR system recording images or there is some kind of issue with the system because I entered the car park twice in one evening. 


Below are the details of what happened with the clearest timings that I could identify. 

  • I entered the car park at 19:27:36 and immediately left straight after.  I did not park, stop the vehicle or leave it at any point. 
  • There should be clear ANPR footage of me leaving at approximately 19:28. 
  • I then drove home and again left my address at 20:35 in order to be in Solihull at 21:00 to pick up my daughter from a dramatic production rehearsal, I am able to gain a statement from the director of the performance to illustrate that I was there at 21:00 with my car, if necessary. 
  • I then entered the car park again at approximately 21:22, their ANPR footage shows me leaving at 21:23:05, so they should also be able to see me enter just prior to this. 

They should be able to view the ANPR/CCTV footage around the entry and exit times to show that I left/entered immediately after/before and that I did not park, stop the vehicle or leave it any point. 

As I am new, it won't allow me to post links to my images from a hosting site.


What do I do next?  or what have I missed?

    Giving us the name of the parking firm?  

    What kind of car park was it?  Have you complained to the landowner?  Have you read the NEWBIES FAQ Announcement, first post, which gives you guidance on dealing with the early stages of your parking charge?

    I had already appealed before I found this place, they obviously refused it, but did ask for more evidence.

    Write/ Email the parking company as the Vehicle Keeeper (without identifying any drivers). Instead of "I", you can say "my vehicle was". 
    Ask them for a Subject Access Request for all information,  pictures and video footage of you and your vehicle. In particularly a copy of the ANPR with all pics/ logged VRM of your vehicle's intermediary movements!
    If they refuse like the parking company in my case did - then you can exhibit the email trail of the refusal to the court (and later ICO) as I did.

    Software to prevent double dipping exists, but PPCs steadfastly refuse to use it because they won't make as much money. Instead their software automatically ditches the first exit and second entry, then pairs the first in with the last out photo' and voila, a scamvoice is generated.
    The UK Government has prohibited the use of ANPR scameras in council and local authority car parks because it is not fit for purpose.

    When you send the SAR, ask for all four of your images. When they tell you they don't exist, or whatever weasel words they come up with, complain to the ICO that the keeper's data was unlawfully obtained and processed.

    The keeper will need to include proof of ID when they send the SAR to the DPO of Euro Parking Services such as a copy of the vehicle V5C or two redacted utility bills or bank/card statements.

    Make the same complaint to the IPC, not that it will achieve anything useful.

    Complain to the DVLA that the keeper's data was unlawfully sold without reason. When they whitewash it, complain to the ICO about them as well. The DVLA are already being investigated for this, so every little helps.

    Complain to your MP. Make separate complaints about the PPC obtaining and processing your data, and about the DVLA unlawfully selling your data.

    You should be able to generate on complaint then recycle it for each entity you send it to. Include proof that the vehicle was elsewhere in between the two visits where necessary.

    Thank you, this is really helpful. 

    The only proof I have, other than the possible 4 anpr images, is a written statement from my daughter’s theatre group stating that I was there to collect her at 21:00 (approximately 20 minutes away)and as such couldn’t have been parked in that car park.

    As an aside, I’ve also asked one of the shops there if they’d do me a favour, they’re a local company and hopefully can cancel the parking charge.

    Plan A is always the best option, although sometimes there is a contrsv clause that they can't cancel once its gone so far. But you never know, if you don't ask you don't get as they say.
