    Dear Sir/Madam, 

    PCN ref: ********* 

    This is now the second message that I have written to you refuting this spurious claim, the last one was over 3 years ago and my position has not changed since then. 

    I didn’t receive a reply in writing and therefore assumed that this issue was dealt with, instead your client seems intent on causing unnecessary distress to an innocent party. 

    I have copied my previous message below with some additions where necessary. 

    Following my previous email (14.03.23) to you in regard to a dispute with the above referenced charge.  The Information Commissioners Office has now written to Euro Parking Services (and myself) as “there is more work for the organisation to do” and that “In your case, we expect the organisation to fully address your complaint”, therefore I feel inclined to inform you that if your client proceeds with their spurious claim I am left with no choice but to file a counter-claim for not less than £300. 

    Your client has been informed by myself on multiple occasions that this is a ‘double-dip’ case (ANPR error and no human checks apparently been made) and have obtained my DVLA data without due cause and are refusing to give me access to all data currently being held about me, despite this being contrary to GDPR.  Why would they need photo ID in order to provide me with my data? This proves nothing, they don’t know what I look like and frankly based on my experience (and the comments from the ICO) with your client I feel unsafe providing them with photo ID. 

    This claim has caused me anger, distress, anxiety and wasted my time for almost 12 months (now almost 4 years) since it all started.  A counterclaim for distress caused by serious misuse of data has succeeded several times before, e.g. £250 was awarded in Simon Clay v Civil Enforcement Ltd; £1500 in VCS v Ferguson and another against VCS in February 2023 resulted in payment of £250 to the innocent party. 

    There is no need for any of this to be happening, yet Euro Parking Services seem intent on pursuing this further.  Cancel this meritless charge immediately.

    OK, here I go.


    Gmail put their registration email in the “spam” folder.

    Their website is painfully slow, actually waiting minutes for it to log in.

    I’m sure they make everything as awkward as possible.

    Done it via their portal.

    I feel sick, I know it doesn’t make sense to feel like this but I just hate anything to do with solicitors, even this kind, instead I need to get angry like I was 3 years ago.

    Well I have an update and predictably they haven’t cancelled the charge.

    Below is the most relevant part of their email:

    “Thank you for your email dated 28th March 2026.

     

    Whilst noted, only the issuing operator has the discretion to vary or rescind a PCN. For the avoidance of doubt, we confirm we do not carry such instructions. 

    Please find attached the Evidence Pack which we trust to be self-explanatory.

      

    Our Client is therefore satisfied the case against you should proceed unless the debt owing of £160.00 is discharged in full. To ensure no further action is taken, you should make payment on or before 4th May 2026.

      

    If you do not make payment, we are instructed to issue legal proceedings to recover the outstanding balance in full. Should it become necessary to issue legal proceedings, we suggest you follow the steps on the claim form upon receipt of the same. ”


    Do I wait to see what happens next?

    Correct, wait and see what happens

    They are correct in stating that only their client, the private parking company claimant, can cancel the pcn, the invoice
