I WON! Case dissmised. They didn't turn up. Was in there less then 2 minutes, would have liked the chance to fight my corner but didn't get the chance. Unfortunately there's no run down to share on here as there wasn't any.7

Well done and thanks for feedback. I wish there were real sanctions against the scum that put people through all this. Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

No-shows are very much par for the course these days, when the Defendant has clearly done their homework, and presented a well written Defence and WS. The parking companies and their solicitors are reluctant to spend ~£130 on a freelance advocate to argue their case, when it is very likely that they will lose anyway.
I have been providing assistance, including Lay Representation at Court hearings (current score: won 57, lost 14), to defendants in parking cases for over 5 years. I have an LLB (Hons) degree, and have a Graduate Diploma in Civil Litigation from CILEx. However, any advice given on these forums by me is NOT formal legal advice, and I accept no liability for its accuracy.4 -
We well done Greenhaze. I hope you remembered to ask the judge to award your costs for attending court this morning. Usually about £953
-
Unfortunately not, the judge wanted it dealt with quickly, I was so shocked at it being dismissed so quickly that I forgot to ask.
1 down 1 to go.
I received a claim from UKPC for parking in my own space over 4 years. Never received a NTK as I sold and moved out of the property 8 days after it being issued according to the sar information. Can't recall if I had the use of my car that day or my partner as it was so long ago.
Do I need to start a new thread for this PCN from UKPC. Defence was filled last month as received the claim over festive period reducing the amount of time I had to submit it.0 -
Ask the judge for costs under CPR27.14(2)(g) for unreasonable behaviour. (£19 an hour for your time), If he/she demurs, read this,

You never know how far you can go until you go too far.0 -
Greenhaze. It makes it much easier for the regulars if you start a new thread for each claim. Now you have been through the process you know what to expect including the claimant not bothering to turn up. Make yourself a list of key points you wish to bring to the attention of the judge next time including a request for your costs. Don't forget to utilise and bring the courts attention to the new Code of Practice in your new witness statement6

Do I need to start a new thread for this PCN from UKPC.You can if you wish, but you do realise, don't you, that you now have more first-hand knowledge and direct experience of the court process than the vast majority of regulars advising on the forum.Your experience could help hundreds of other posters already with court cases seeking help here, or those due to appear some time soon! Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

I wish I had more to share on the experience in court today but it was so brief. But what I would say is that it has taken up alot of my time researching and reading and gathering all the evidence up to prepare for today more than I was expecting. Looking back at how much it had consumed my life, I find my self questioning weather or not should I have just paid the original PCN.
However knowing what I know now, I'd never bow down to these scammers again and dred to think how much money these company's are stealing from the motorist who don't defend their cases. Like someone mentioned on here before that you might as well stay and fight as you have nothing to loose but only gain. I will use what I have learned on this forum already from those very knowledgeable people and apply that to my next PCN, atleast now I'm more prepared than the first time round. I'd like to say thanks for those who helped me along the way, I couldn't have done it without you.3
