  • Regarding primacy of contract I am the partner and father of the child being escorted into the premises. The lease is not in my name but in that of my partner/ and mother of the child so do I still have primacy or not. I have a copy of the lease to exhibit but is it worth using it?

    Yes I would say you can reasonably state that parking rights or easements extend to spouse/family in that residential household.

    I've not checked back through the entire thread, but are you definitely having a face-to-face hearing at you local county court, as opposed to a video/telephone session?  Even if it is a f-t-f, I'd still send an electronic copy, particularly if you're going to be supplying links.

    Due to disabilities I requested a face to face appearance so 100% in person as this the appointed date after I previously raised the issue prior to the original court date. Do judges prefer to examine the bundles on paper or electronic as it saves them from having to click on multiple things at once?

    Pass ..... there'll will be as many preferences as there are judges. You could issue an electronic addendum to the paper-based WS with any internet links the judge might want to quickly access. Email to the court and ask that it be forwarded to the judge - make sure the attached page contains all your court and personal reference numbers so it's not just an unattributable attachment.

    Is/has a copy being/been given to the claimant/sols?
  • Will be sent via email when it's 14 days prior to the court date. I will hand a paper one into court and a email version. Has I gave alot of exhibits and email is limited to a certain file size am I able to use things like a wettansfer link or drop box ect...for the solicitors copy?

    You will have to ask them , not us , we wouldn't know what each solicitor firm requires !

    Alternatively use a paper bundle as in pre covid19 days

  • I have an email from the legal land owner giving the claimant explicit instructions to cancel the PCN which the managing agent was also CC in, explaining that they have no contract with the claimant, but was ignored and continued to pursue me down this path.

    My questions is this exhibit is under my heading the The Contract, which is a third of the way down in my WS. Should I be putting this up at the top and making it apparent to the judge straight away?
