UKPC parking ticket for being over 10 minutes, I am disabled, appeal ignored.

I am emailing you because I want to share a story that effects many disabled people as well as the elderly. In regards to parking, and the fines we get, for being some what slower than the average person.
Many retail parks, supermarkets, stores and businesses use private parking company’s like UKPC, Parking eye, etc to control their parking areas. However, unlike council parking areas, Private parking company’s use ANPR cameras. Which councils are not aloud to.
The use of ANPC cameras by private parking company’s means they can not determine who needs extra time due to protected characteristics of the equality act 2010 relating to disability. Which in turn, means that disabled people are being ‘charged’ for overstaying for no fault of their own, other than reasons relating to their disability.
Every other company/ businesses in this country must and has to make reasonable adjustments for disabled people. This should also apply to Private parking company’s. However, they seam to believe they are above the law and above everyone.
I have again, recently been sent a ‘invoice charge’ for overstaying in a retail car park by 10 minutes. Whilst shopping at ‘The Range’ and ‘B&M’ in Bury st. Edmunds on 6thDecember. Because it takes time for me to do my shopping, unclamp and clamp my wheelchair in and generally just be as independent as possible. I have tried to appeal the ticket and my appeal has been rejected.

The private parking firms rely on disabled people and the elderly not knowing what to do, and being scared of their letters and threats. They ignore appeals, ignoring the information being given to them and evidence sent to them that the person was shopping and was/is disabled and requires reasonable adjustments.
If it was not for the kind people at MoneySavingExpert online, I would have fallen for these scare tactics many times. However, I fear that many disabled and elderly do fall for these scare tactics and do not know where to turn for help, many also do not have the strength to fight the private parking company’s, I know I struggle to. They make something that could be so simple, very long and complicated. There is absolutely no need to put disabled people through what they are doing. It’s appalling, and they need to be held accountable for their actions. No other company/ businesses would be aloud to treat disabled people in this manner so why can private parking company’s?
This thread here shows how scared I was from my first parking ticket, how they had me believing people would be coming to my door demanding money, because I over stayed, trying to pay their meter as the pay by phone was not working.
The new parking code that is looking to be introduced, must and needs to include regulations that private parking firms, must follow when dealing with disabled people in particular blue badge holders, just the same as the council are held accountable and all businesses. At current, there is nothing.
This is not the first time I have received a parking ticket for reasons relating to my disability, and I am sure it will not be the last. But it is time something is done to stop private parking company’s bullying the disabled and the elderly.
The retail stores are also to blame, they need to take responsibility for who they employ to look after their car parks. They are scaring of disabled and elderly costumers, not welcoming them, by using bullying private parking firms who will not make allowances for disability related needs.
I do not believe it is fair or acceptable To issue a ticket to a disabled person who was 10 minutes over the 3 hours parking, because they where there shopping and it took them longer than the 3 hours to shop, and be loaded and re clamped into their adapted vehicle.

Please help me spread this information out, disabled people need to know that this treatment they are receiving from private parking firms is wrong. They need to know there are people who can and will help them. Retailers and businesses need to take responsibility for the parking company’s they employ, and think about the customers they are losing because these private bully’s are scaring them off. The government needs to make sure the new code of conduct protects disabled people, especially blue badge holders. And the private parking forms, must be held responsible for their actions, no other businesses is aloud to discriminate against disabled people, so why should they be getting away with it.

You could add a link to this 2010 article, that shows that what you are saying is true and has been known for over a decade, before the DDA was replaced by the Equality Act...yet nothing has been done by parking firms:

The changes by Le_Kirk look good, but I would consider making it much shorter.Make the opening sentence mention elderly people before disabled, as it refers to a wider group first. For example:"I would like to highlight an issue that affects many elderly and disabled people in regard to parking, and the Parking Charge Notices (PCNs) we get for being some what slower than the average person."I would remove the links to the threads on here, along with their preceding sentences and just put a grateful mention of how helpful people on Money Saving Expert have been. The youtube link could be removed as well, along with the whole of the last paragraph. Perhaps just replace it with a single closing statement along the lines of "How can private parking companies be allowed to get away with this?"People generally reading it are most likely to lose interest before reaching the end. If the recipient of the letter/email wants more detail, they will get in touch with you.Apologies, but you did say "attack" it!I do wish you luck sorting this particular ticket out. In Stacey's case the YouTube video is particularly revealing and apposite. In the grand scheme of things on the disabled person front, Stacey has a greater difficulty than most in doing what even many disabled people would find relatively easy and straightforward in their daily life.Please note, we are not a legal advice forum.
