    It states on the letter tha each party must deliver to the other party and the court office copies of all documents on which that party intends to rely at hearing no later than fourteen days before the hearing.
    Hearing is 10th December, so this will be 26th November.

    They must pay fee by the 12th November.
  • Okay so if they pay the hearing fee you will have a fortnight to provide your WS. Should be enough time but might be worth getting the bones of it together then you are not feeling rushed to produce it. I suggest you ring the court on the 13th  Nov to check

    Without tracking back through the thread, if you're arguing no Keeper liability, here is a map of STN boundary to show that McDonalds (and Starbucks) Southgate Park is within the airport boundary and therefore land under statutory control (airport bylaws) and therefore not 'relevant land' for the purposes of PoFA.

    We refer to the above. 

     

    Our client has reviewed your comments in defence of their claim and is mindful of the Court’s encouragement to settle claims without the need for a hearing. As such, our client is willing to accept £141.49 in full and final settlement of the claim.  

     

    This offer is open for acceptance until 4pm on 12 November 2024 and should you wish to accept the offer we would request payment is made to the following bank details:

    It is no suprise that they have given a deadline of 4pm on the 12th November as this is when the courts have given them until to pay the outstanding court fees.

    Shall i respond to their e-mail and if so any suggestions, or just leave it and see if they make the payment or not.

    Why respond. They know they don't have a leg to stand on. Leave the ball in their court and check with the court ton the 13th to double check if they've paid the trial fee.
  • I agree they want you roll over and pay them something rather than have to pay the hearing fee and then probably lose in court.

    Haven't heard anything, so i will check MCOL tomorrow and call the local court to see if they have an update.

    Fingers crossed that they dropped it / didnt pay and the court threw it out

    No need to check MCOL. They lost all interest in this case once it was transferred to a hearing court.
