    still nothing on MCOL and now it shows they have received the claimant DQ. I have sent it 3 times now.

    I received a change of location for the hearing on the 15th April, but heard nothing since.

    Is this normal?

    Possibly. Why not ring the hearing court if you have concerns?
  • Hi guys. I got done by these lot back in early May. Revieved the 14day letter. Than the 28/30day letter and have had a couple of letters since (every 3 weeks or so).

    My most recent one came this morning from trace (their 4th one to me) with the words:

    "We refere to our previous letter advising you that our client has instructed us to assess and prepare your case for escalation to their solicitor we have completed our assessment and can confirm that we have prepared the evidence against you and your case has now been selected for referral to our clients chosen solicitor who may commence legal action against you through the courts when taking any legal action are client must demonstrate that they have done as much as possible to settle the matter this can be widely known as pre-action protocol as such our client has instructed us to write to you offering your final 14 days to settle this matter"

    This so far has been the most threatening and i have ignored every single letter thus far. Should i do something or should I pay? How many steps come next before court if it goes that far etc. 

    Any help :(

  • Hi All. Latest update.
    I had until last week, still had no communication from the court, which was a little worrying as it was 6 months.

    Last week i received a letter of allocation to the small claims track, saying that on the 16th July Deputy District Judge had considered the statements and DQ and allocated the claim to small claims track. 
    The date is the 10th December 2024.

    One interesting point is the following statement on the letter:

    Unless the claimaint does by 4pm on the 12th November 2024 pay to the court the trial fee of £27 or file a properly completed application for help with fees than the claim will be struck out with the effect from 12th November without further order and unless the court orders otherwise you will also be liable for the cost which the defendant has incurred.

    Is this the normal process?

  • Yep. Met Parking will have to pay a hearing fee if they wish to proceed.  You will have to prepare your Witness Statement by the date given on that letter of allocation. Usually claimants and defendants have to provide them to the court and the other party 14 days prior to the hearing. You must check. If that is the case you may find the case is struck out before needing to prepare your WS.

    Yes but the OP hasn't told us the important bit.  The deadline for both parties to file a WS.
