In para 21 you make reference to para 27 with regard to new CoP  -  however your para 27 does not state anything about this.

oh dear. Thankyou so much for picking up on this.
I really dont know how to do the cost assessment -is it as simple as copying and pasting from somewhere?
goodness this is difficult. new found respect to those working in law!
Look at @aphex007's WS (version 3)linked in his thread - see his post at 7:26pm on 12 June - and go right to the end of the WS.  That is how to lay it out, but you must put your own figures into your WS.
Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

  • In para 21 you make reference to para 27 with regard to new CoP  -  however your para 27 does not state anything about this.
Thankyou as that had been missed.
Would you advise i should just delete the comment in brackets saying to see paragragh 27?

I have got my WS ready to go with all exhibits etc attached.
The only thing i have to attach(i think!!) is the schedule of costs.
It needs to be submitted today.
I have read through lots of different experiences on here and it seems to be the advice is to put £19 an hour?
    I also found this
"Cost of attending any hearing - should that be necessary - travel to and from court. Loss of earnings due to attending a hearing - capped at half a day at £95.00. Court fees - filing fee and hearing fee. Take a payslip or similar to confirm any loss of earnings."

Im thinking as I wont lose costs to travel to the hearing therefore i wont put that bit in or the bit about stationary and printing (as i havent done any)???

Im at a loss for what to write:(:(
Please give me your expert advice.
    thankyou
  • Anyone please able to guide me?

You have to prove unreasonable conduct by the claimant or their solicitor to have a case for your additional costs.  Unless you have a really good case (and I mean REALLY good) just go with your £95 but don't forget to take a wage slip as proof of loss of earnings.
