    No, 'if you lose and a big 'if', you pay it within the specified time limit.
    I am not up with the procedure but I assume it is 1 month to pay off.

    Kerp up the pressure and ALL of you get your respective MPs on board to write to the landowner and to VCS and to the IPC as well,  to state the signage is clearly inadequate and the charges must be cancelled.

    The IPC need to receive MP complaints about this trap zone.

    Get your respective local MPs to also ask Neil O'Brien MP (who the BPA have publicly stated to now be responsible for the new Code of Practice)  what the DLUHC are doing to stop entrapment areas with two VERY similar looking sets of signs in adjacent car parks as this one has fooled dozens of gym users who are all cancelling their memberships in droves and are up in arms.  And to ask on what possible planet are parking firms allowed to add false 'debt recovery costs' per PCN which is out of all proportion to any legitimate interest and appears to be just an illegal penalty clause?  Consumer law does not allow late fees and the way round it is NOT to say 'it's OK, we understand this is a sensitive subject so in future they can just have illegal penalty late fees 'as of right' under contract, by putting it on the signs.' Which is shockingly, what the DLUHC proposed in their August public consultation.

    No, no, and more NO.

    Please get your MPs to use your cases as examples of all that is rotten about the parking industry and not to accept being told it'll all be OK because we will let them put the illegal fake.costs on the signs as we want there to be 'consequences' for victims who dispute and recuse to pay.  This is no more acceptable than these signs are.

    Invite your MP to go take a look with you.

    Re. the paying in instalments query (if a claim was lost) ... yes, you can go down that route. However it would be utterly pointless to do so as it would mean that you still have a CCJ filed against you, which would get marked as Satisfied after the last instalment payment cleared.

    In other words, if you're happy enough to have a CCJ registered then you may as well not pay them anything - paying in instalments doesn't improve your creditworthiness one iota as the CCJ would still be there (for 6 years).

    But please let's not get diverted by that scenario which is highly unlikely.  Even if people get claims, we win almost all of them and all these victim defendants could get together and get it in the paper and provide WS for each other's cases to show that this signage is inadequate

    Thanks Jenni - but when would the CCJ go on someones file? Before the first court date? Surely thats not fair. I thought a CCJ would only go on your file if you didn't pay within the specified time limit set on the day of court (if someone lost)?

    If I drag this out and ignore their threatening letters they will issue a court summons (maybe)? Would a CCJ go on my file in the meantime?

    No, they can't apply before a court date
    I suspect they may well take you to court, so preparation is the key to winning.

    You don't get any CCJ (not even if you lose, because you then pay) merely by defending a claim, as long as you follow our advice and all court directions.

    The thought of a CCJ is irrelevant to the case.  There is zero risk - with the above caveats - otherwise we wouldn't put people through this.
