  • Evening all,

    Short update, but had a letter come through from the County Court I applied the hearing to take place at:

    “Notice of Transfer of Proceedings”

    as well as;

    ”General Form of Judgement or Order”

    First was just to say its been transferred to another court thats more local.

    Second letter states the file has been allocated to Defendants home court, and that:

    This Order has been made without a hearing under the Court’s case management powers contained in the Civil Procedure Rules , Part 3. You may apply, within 7 days of the service of this Order, to the Court to set aside or to vary the Order under Part 23, Rule 10. If you do so, you must file to the court and serve on the other parties an application that sets out your reasons for objection and pay the Court fee or apply for a fee exemption.”

    Can anyone outline what this means, what I need to do next, and where?

    Just means you can object if unhappy with the court allocated. You need do nothing.

  • Good afternoon all,

    Been a while since last comment - hope you’re all well!

    I have a face-to-face court date!! It’ll be midway through April 2023.

    I’ve received that Notice of Allocation to the Small Claims Track (Hearing), dated towards the end of August 2022, advising me I must submit the Claimant and Court office copies of all documents, and evidences I’ll be relying on and taking to court - I have until 28th September 4pm to do this.

    I still have my previous evidences / images / documents from my previous case as this was at the time of the alleged infringement - am I still OK to use these (with the exception of any late / recent documents that has come about, and updates to the templates, etc., since then)?

    I’ll will be working on this within the week and hopefully get a draft version out midway next week - grateful in advance for your assistance and feedback.

    As it's a while since you last posted, I thought I'd draw your attention to this fairly recent thread which you might have missed. You must keep going through all the court procedure phases, but the hope is that your case ends like all those detailed in the thread. 

    Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .
