    On the entry and exit pictures captured by the claimants cctv, the times are present and precisely equivalent to 10 minutes and 40s.

    Therefore, would it be okay to say it took less than 10 minutes?


  •  3.     In October 2020, I received a PCN through the post for waiting in the car on a private land whilst my ran to the shop to pick up a few groceries. I believe the shop took less than 5 mins and I was parked on the spot for less than 10 minutes which I think is the minimum grace period as per the Trade Body Code of Practice.  

  • As for para 6, shall I just remove it?
    It doesn't seem like its serving a purpose, what do you think?

    Yes of course.

    The suggestion was "...you were actually parked for less than ten minutes all told".

    I.e. some time was taken between passing the camera and actually being parked... and again when leaving. So the vehicle was actually parked for substantially less than ten minutes.

    We haven't seen a new draft including  the extra stuff about the new DLUHC Code of Practice, that I told you about. As I said "For inspiration there are a couple of posters working on WS right now, who have included it."

    In fact there are loads of threads that now include the new wording.  Read any claim thread from this weekend that's at WS stage.

    Also you don't seem to have included any Exhibits.  How the whole bundle should look is as shown in the 2021 threads by @Nosy or @jrhys albeit they didn't have the benefit of the new Code to add.  You do.

    I've created a new paragraph 4 onwards to replace the template defence:

    Showing you and others, even though your defence is in and you are at a later stage, because it should be fairly easy to adapt and use in witness statements.

    Debt recovery 'cost/fees' are now banned from being added to parking charges, and that new wording explains to a Judge why that is relevant for existing cases, too.

    Also read the whole new DLUHC Code of Practice because it covers all the ususl points and issues, and states the best practice position.

    Not retrospective but you can use it in a WS to effectively say 'Here's what a professional parking firm should have done'.
