It might be risky to negotiate, they may put you on an "easy prey" list and sell it to other scammers. You never know how far you can go until you go too far.0

Tiredofparkingfine said:KeithP- thank you very much for your help.
I'm not sure if I can do this, I don't know how I will produce a ws when the time comes.
What if I call qdr and ask them if we could negotiate on a lower amount to settle the case?
Is it wise to do this?
it really is copy and paste and insert your story/facts.
no one, but no one, would call QDR. Forget that silly idea entirely, this process does not involve you writing stuff from scratch. WS stage is dead easy.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Thank you very much to all.
Your help does give me alot of hope.
So I have understood what to do with the questionnaire now so I will send it off.
And then move onto the next stage.2 -
Hello to all,
So last week I send the DQ by email to the court and claimant.
Next day i received the questionnaire from the claimant, do I just ignore it?
Secondly, now I Don't need to do anything till I receive a date for the hearing? How long does that usually take? And how will I know their not proceeding with the case anymore if they decide not to as I have read on another thread alot of times they don't end up going to the courts.
Thank you very much

The next thing will be the matter will be assignee to your local small claims court, then the Claimant will be given a deadline to respond to your defence which will be sent to court plus yourself. Then if its not already struck out it will be a WS then potentially a hearing. Although a lot of cases are struck out if you put up a good argument at the WS stage.
There are plenty of good templates, resources and knowledgeable people in hand here. Don't give up.

Hi there,
My hearing date is getting close and I'm getting very worried now.
I have to file my ws before the 11th of march.
I have been reading but can't seem to find any ws that is same as my case.
Is there something I could just copy and paste as I don't think I can create my own.
Do I have any chance of winning this case?
Any help will be greatly appreciated
Thanks in advance0 -
Is there any point mentioning anything about the scammer that has landed me into this?

I just want to mention that alot of the cases I'm reading are events that occurred in an actual carpark however in my case it wasn't a carpark.
Its a small tarmaced area just off the pavement without any actual boundaries or fence etc which is private land and there's a camera there. I was on the land for 10 minutes and 40 seconds. I was in the car waiting for someone. Had I noticed the camera I would have avoided the area and just waited on the Pavement. Made no difference to me. But I didn't notice the sign or camera at all.0 -
I have to file my ws before the 11th of march.Just over 2 months then!I have been reading but can't seem to find any ws that is same as my case. You never will.Is there something I could just copy and paste as I don't think I can create my own. Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .
I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

If the area of land was in front of the shop where your occupants went into why didn't you complain to them? What exactly did the signage say?Did you get photos of the area, the signage etc.Waiting in the car isn't a defence. It's not a fine it's an invoice. It doesn't matter that it is not a large car park it's private land, same scams apply. If you didn't see any signs it means they weren't prominent.I do not see how you have got this far without considering all the above, and that list isn't everything that should be covered.Your appeal to these muppets appears to show you think you are dealing with reasonable people, they do not have any scruples at all only greed. You cannot appeal to their good nature their business model needs people like you to transgress their made up rules to fill their bank account.2
