I can't find anything contradictory with my original statement, unlike yours.The few problems I encounter with Paypal are generally customer errors or chargebacks for undelivered goods (as I said a handful a year out of thousands). Apart from making me wait a couple of weeks until they check with the tracking, they are fair and accessible. If you follow their guidelines it is difficult to go wrong. It isn't Paypal who use stolen credit cards and it isn't Paypal who send out dodgy goods. Call their charges and their customer service all you want, but don't say they screw people out of money if you can't back it up.
You have stated that this thread is a good example of how Paypal is "screwing" its customers, I would beg to differ, the original posting doesn't say or imply that at all. There are no previous threads you have commented on or posted about that would back up your original statement. If you have personal experiences then I ask you again to share them and back up your statement..0 -
I was interested when reading this thread the comments from the op about the statement that paypal proved that the ip address was the same..
One question... do you use a wireless network and is it secured ?

I do have a Wireless Network, and its secured with a WPA key.
And to answer why i didnt ring up in the first place, was because i just thought there was some stupid mistake going on and emailing them would suffice, in which i had some emails going back and forth for awhile until they stopped replying, so i left it. Only when they got IJ on me i made the call.
Anyhoo, nothing new to say atm, my account has now been locked and i havent heard anything more from PayPal, IJ or those solicitors.0 -
Another call from IJ.....they seem a bit desperate...
3rd time ive told them im not paying it and why, but this one was strange. She read out my email address, which was right, then she asked if my login was "Lloyds TSB", i was like.....eh ? Just said no to that one. I asked if they had actually spoken to PayPal at all lately, to which she said no. Useless bums.0 -
This is getting comical, another 2 phone calls from them, same old "outstanding debt" from a completely different person, told them for the 5th time i think now that im not paying them......wont they get the hint ? What do they think im going to do, slip up and go "Oh yeah sure here ya go !".....0

I agree, I'd tell them that another call and I'd go to the police for harrasment (and really do it if they did).BTW: Please keep the updates coming, people like me are reading, we just don't have much to add!

Small update, had another call but it just went through to an automated thing saying "please call us back later". Sure....
Also, had a call from someone else today asking for my mother, told them she was at work and that was that. But i checked the number (01619352123) and it appears to be another Debt Collection agency, so im assuming its in relation to that £230 that PayPal reversed on her PayPal. I thought they wouldnt chase that up ?
Can they legally get that money back ? (Sorry if you dont know what im on about here, i explained it earlier in the thread

Have you written to them stating that the debt is in dispute?
If not, I would write to them saying the debt is in dispute, and that all further communication is to be by letter only, and any further phone calls will be reported to the police for harrassment.
I have sent the first letter from here:

They replied saying the debt is not part of "consumer credit acts" and that by agreeing to paypals terms and conditions you agreed to pay them back if the balance went into negative.

Thank you for your letter dated 31st Dec 07.
I do not acknowledge any debt to your company or your clients.
Paypal have unnecessarily called in Instrum Justicia to resolve matters when I am prepared to resolve with Paypal - However Paypal have not had the courtesy to properly explain why they withdrew my funds without any prior notice. As I have not been given sufficient notice or information, I am unsure whether Paypal have the right to remove money from my paypal account without my knowledge or permission since I do not know what was wrong with the payment I received. The money came from a well known friend of mine, who was a verified buyer with a confirmed address, not a complete stranger, and I am surprised that he would knowingly be involved in anything fraudulent. You understand that there are implications concerned with the Data Protection Act, but I want to be sure that this is not just some form of whim on Paypals part and therefore would like more details of what happened. I have sent several emails to Paypal - all unanswered to date, and regard myself still in dispute with Paypal over the matter, and as such, they were wrong to call in a Collection agent while the dispute is ongoing.
Further, if Intrum Justicia, being informed of the dispute, continue to demand payment, then they are in breach of the OFT guide lines on debt collection. As Paypal have instructed them, then Paypal is jointly responsible for IJs behaviour. If IJ continue to harass me, then a complaint will be put to my local Trading Standards that they are not a suitable company to hold a Consumer Credit Licence. I will also consider a complaint about Paypal at the same time. In the light of the lack of details surrounding the withdrawal of the money, I will vigourously defend the matter should it go to Court. However, I hope that this will be unnecessary and look forward to a reasoned dialogue with Paypal to resolve the matter, as I believe I have managed my account in an appropriate manner according to their terms and conditions. If accepting payment for goods from a verified buyer with a confirmed address is not managing my account in an appropriate manner according to their terms and conditions, then every other Paypal user is in breach of contract.
To summarise the reasons the debt is disputed:
1. Paypal took it upon themselves to unlawfully put my account into a negative balance, this was done through no fault of my own and Paypal did this themselves, creating debt where non existed before.
2. The money was given to me in payment for various item from a verified buyer with a confirmed address.
3. I can provide receipts proving that these were provided to the buyer. Paypal have not allowed me to produce this evidence.
4. Paypal said they were returning the money to the buyers account - however the buyers account is in fact closed, paypal are aware of this.
5. I have attempted to make a complaint to paypal regarding this, but have been ignored, and have sent several emails - all unanswered to date, and regard myself still in dispute with Paypal
Therefore I am requesting the following:
1 Proof of the debt
2 A Data Protection Act 1998 Subject Access Request, in order to find out how you obtained my details, and where this alleged "debt" came from
3 The deed of assignment allowing IJ to collect this debt
4 A statement of account.
As this debt is in dispute you have no legal right to pursue this debt, OFT guidance states that failing to suspend collection activity whilst a debt is disputed is considered an unfair practice, and that since your clients already have full details of the dispute, you should refer to them. Paypal are not a credit lending company of any sort and I have not signed any form of credit agreement with them, Paypal took it upon themselves to negative balance my paypal account of there own accord, and this debt is in dispute with paypal.
Data Protection Act (Data Protection Act 1998)
Furthermore, under the Data Protection Act (D10), you are also denied the authority to pass on any of my personal data. To do so in the circumstances is I understand a breach of the Data Protection Act 1998, and also the OFT guidelines, and should you ignore my request it would again result in you being further reported to the relevant authorities.
I also withdraw the implied right of access to my property This letter denotes prior written and legal warning that any such visit will constitute trespass and harassment. Normally there is an assumed right of entry to the front door of a property. However this is denied to your employees, or anyone working on your behalf, since any such act will evidently constitute harassment since prior warning has been given. Your company will not send me any threatening letters or any other correspondence; you will not visit my property, neither will you visit my home. You may, of course, reply to this letter. I also request that all correspondence is by post only.
I look forward to your reply within 14 days to resolve the matter amicably.

To which Intrum Justitia say they are now holding the debt in "abeyance" (suspension) and referring it back to Paypal. Note, I also sent the letter / email to paypal, they replied saying "yadda yadda we don't care and we still want the money and this is the final word on the matter".
Irwin Mitchell have since (today) contacted me with a letter, which is in breach of OFT guidelines (to persue a debt in dispute), so I have complained to The Financial Ombudsman: http://www.financial-ombudsman.org.uk/consumer/complaints.htm (phone number and email address on this page).
IJ are also in breach of the Data Protection Act 1998 by passing on my details to Irwin Mitchell, so I may also be making a complaint regarding this to ICO:
