    It's not true that you are not protected. You are protected by the law - but not by Paypal. What Paypal would love to do is just whip the money off of your bank account or credit card in cases like this .. fortunately, the law prevents them from doing this. Which is why they resort to bullying tactics such as the above in an attempt to scare uninformed consumers into giving the money up of their own accord. I am sure that there are hundreds, if not thousands of people who have probably had situations like this over a few hundred quid or even less, and just paid up for a quiet life.

    Also, it strikes me that there is a very simple way that Paypal could help to resolve cases like this. If you add a bank account to Paypal, there is no way of viewing the full account number and sort code - if there were then you could easily identify the account to which the money had gone, and inform the relevant bank. Why don't they do this?

    obviously because they probably know that the bank account isn't linked to the OP, they are just using their scare tactics to try and frighten the money out of the OP's pocket.

    Let me add to this, Paypal took it upon themselves to put your account into a negative balance, This was done through no fault of your own and they did it themselves,

    I take that as right yes!

    Firstly paypal or not a credit lending service of any sort and they cannot take you to court for this and will not and just in case you where going to ask NO they cannot affect your credit rating or place anything on your credit file whatsoever,

    Please believe me as I had this happen to me several years ago when I got stung by some very nasty people,

    Contact the company who are trying to chase you for this money and ask them for your signed credit agreement with paypal,
    Give them 7 or 10 working days to respond.
    You will receive nothing apart from an email address it is linked to and any other form of rubbish they think will scare you in to paying, If anything at all that is.

    For you to owe a company money you would have needed to have borrowed it from them and to do this you would have needed to sign a credit agreement of one sort or another,

    Send a letter to the debt collector explaining this with the time limit to respond,

    They may send you the odd letter with what they are going to do and you will need to do this by a set date or they will do this and that,
    Then within six months they will offer you the chance to clear the debt by paying only half the amount they said you owe,
    Ignore it they will go away in the end as there is nothing they can do whatsoever.

    Trust me they will do nothing as they have no grounds to claim against you,

    Keep a copy of your letter as the debt will do the rounds with the collectors and you may get letters from others over the years I did,

    If you do send them the same letter as you sent the first one and it will stop after a while,

    In case any one is wondering how I can be so sure about this my brother works for paypal,

    I am in a vaguely similar situtation...

    I'll try and keep it short...

    Friend pays me £700ish into my paypal account for holiday that I booked
    Friend closes his account ...
    Paypal then dispute / reverse these payments to me and put them back in his closed account (apparently).
    I contact paypal numerous times and am ignored
    Now Intrum Justitia are chasing me for the money.
    I phoned them and explained I'm disputing it, but they don't care, and would like the money (as far as they are concerned Paypal closed the dispute).

    Any advice...?
    If I were to pay paypal directly would IJ stop chasing me, or would it be better to pay IJ?

    My friend says I shouldn't pay them back at all, but I don't want to be harrassed for the next several years of my life...

    You need to get on the blower to paypal if you haven't yet. Don't be fobbed off, paypal email support will not be any good to you in this situation.

    I've spoken to paypal, they say that seller protection does not apply in this situation, and that there is nothing I can do, as they have reversed the transaction as my friend's account was funded in a fraudulent manner apparently. They were not able to tell me in what way it was fraudulent, other than stating how it may have been funded fraudulently (eg stolen credit card, etc etc).

    Your problems with paypal come under the same situation as posted above,
    If it happens through no fault of your own then send the same sort of letter to IJ re signed credit agreement,
    No credit agreement, no grounds to make a claim against you, end of story.
    If you are worried about them having your contact info and are phoning you up all the time then contact your phone service provider who may be able to help you by blocking there calls as you can tell them that they are harassing you for money and its causing you sleepness nights.

    Looks like il be getting a phone call from Intrum tomorrow, so im curious, its safe for me to tell em to basically sod off, speak to PayPal and dont ring me about this again until they prove it owe them this ?

    Thanks for the replies ebay-expert, ive always thought about this. I didnt actually get into the negative, PayPal themselves put me into it, so really they cant do anything ?

    No company can get money out of you unless they are a secured creditor or you have a credit agreement or they have taken you to court ( a little over simplified, but that is the essence of it! ).

    If a debt collection agency is chasing you for a long period of time there is less and less chance they will take you to court.

    Without court proceedings all a debt collection agency can do is request the payment and threats of taking you to court. If they harass you, this can be against the law and they can be reported (trading standards are usually more interested than the police depending on the circumstances).

    You do not have to speak to anyone from a debt collection agency. I would suggest to always write to the company who are claiming you owe them money in these cases Paypal, address to the Chairman/CEO at the registered head office. Always keep copies of letters. If phoning, get the name and position of the person you speak to and date and time of calling. Keep all records, however trivial they may seem, in case it does go to court at any point.

    Intrum Justitia, have recently been on Watchdog in connection with people being pursued for money allegedly owed to Brittania Music, in those cases they were unable to say what the debt was even for, let alone have paperwork for it.
