    Most debt collection agencies won't know (or care) what the money they are asking for is. All they do is send letters/make phone calls/send agents, they have no power or authority. They are essentially bullies to make people pay up whether they owe it or not. A lot of the time people pay to avoid hassle, that's why these companies exist. It might not be usual advice, but under these circumstances, if you can handle the odd phone call or nasty letter, ignore them. Only take them seriously if they have court enforced powers.

    Oooh got a letter today, from some solicitors called Irwin Mitchell, basically demanding the payment within 7 days of the letter (7th of December, meaning today is the last day), or theyl do some "legal proceedings" against me without further reference.

    What do you guys know about these if anything ? They serious or just trying to scare me ?
  • If Irwin Mitchell have said they will issue within 7 days they usually do.

    I see them a lot in my job as they do a lot of personal injury claims and they do issue more court papers than some of the other solicitors I encounter.

    At least if you go to court, they'll have to satisfy the judge that the debt is yours and have the paperwork to back this up inc the bank account details etc.

    Respond formally saying you want proof of the debt and ensure its sent by recordable post.

    How is the letter worded? I suspect it will be along the lines of "if we do not receive a reply within 7 days we may be forced to start legal proceedings". I doubt there is a firm threat of them taking you to court. They usually use lots of may/might/could.

    Your best chance for resolution is for them to take you to court, so wait the 7 days, I would guess that you will receive another letter by then or a little bit after offering you a repayment schedule!

    Yeah its worded exactly like that, "Should you fail to make payment of the above sum directly to Intrum Justitia within 7 days from the date of this letter we may be instructed to issue legal proceedings against you without further reference. If legal proceedings are issued you may be responsible for any additional fees, costs and interest."

    Im happy to wait to be honest, if this goes to court, like you say, that bank account the money went into will have to be exposed i assume, then well know exactly what went on.

    Yep your right as RFW said, They cannot do a thing and paypal will never take you to court neither will the DC who is chasing you due to the fact you ever signed any form of credit agreement with them,

    They will make all kinds of threats but thats all they are, These people buy these debts from paypal for pennys in the hope of scaring people into paying.

  • As RFW said, When you read the letter its full of If and We May as below,
    Ignore them they will go away I promise you.

    Paypal use whoever will take the debt be it DCs or Solicitors, None of them can do anything and there has never been a recorded case of paypal going to court ever ever!!!

    Thanks for the replies :)

    Just got off the phone to IJ's, just basically wanted me to fork over the money and i said no, its not my debt, and she didnt understand how it wasnt, and that "surely" someone had used my name to do this, which i said i didnt know, as i have no idea how someone did this. Then this "this has to be paid or further action will be taken" to which i said "yes please, as then this can be sorted", end of call. Bring it on PayPal...... Il keep you lot informed :).

    Keep this thread up to date mate, Let them do whatever I guarantee nothing will come of it and no court papers will arrive, Just be sure to send them that letter about credit agreement (recorded delivery as well)

    i got this exact same letter today dated the 7th this is causing me areal headache basically we sold a phone on ebay, it sold for £400 we posted it signed for parcel force and have the tracking information to prove this the person left us feedback and we carried on with are happy little lives. 4 weeks on paypal have reversed the transaction and told us we owe them th money as it was a fraudulant transaction and the person did not receive it ! they said they needed proof so whe sent them the tracking info. i also informed them of the positive feedback we recevied for the transaction on ebay.
    once we had provided the tracking info they then told us that although we had they information they needed we had sent it to a unconfrimed paypal adress therefore we were not covered under sellers protection and the debt is ours to pay. we have since then had harrasing phone calls from intrum justia and letters. my partner then sent them a letter requesting a signed contract between myself and paypal, we sent this recorded delivery they sent us a letter back on paypal headed paper to say that we had ticked a box. the letters began again and now this letter has arrived irwin mitchell threatening legal action. any ideas this is driving me mad we no longer have the phone and they say we owe them money and i receive it on the deadline day what can we do, sorry if this is all a bit muddled its worrying me to death.
