PayPal say im a thief and to pay up

    Same advice as in the rest of this thread. There isn't a lot they will/can do but threaten you. Seek some professional advice, but they are unlikely to take you to court and if they do, will not necessarily win their case. No debt collection agency can do anything until court proceedings have taken place.

    You wouldn't be able to use Paypal again with your name if you don't pay, but that is the only problem.

    Sending a letter that you receive on the deadline day (ie "you have 7 days to respond" received on day 7) is a dirty trick and if they are doing it as a rule rather than by accident I suspect it is not legal. Worth a report to Trading Standards.

    Just as an aside, did you contact the buyer? I had a similar thing and the buyer rectified it, there was a genuine error, its unlikely for that amount but possible. If you don't get anywhere with the buyer you should report to the police as a crime has been committed against you, plus in the unlikely event it does go to court the further details will help your case.

    i have contacted the buyer but never got a reply.

    Keep this thread up to date mate, Let them do whatever I guarantee nothing will come of it and no court papers will arrive, Just be sure to send them that letter about credit agreement (recorded delivery as well)

    Any examples of what to write to them about that Credit Agreement letter ? Im not quite sure what im after (Im 21, i shouldnt be having to deal with stuff like this ! :p ). When i signed up for PayPal, i didnt agree to anything like this then did i ? Meaning anyone whose signed up doesnt have this credit agreement ?

    Put your story in writing to the DC, Explain in detail all thats happened from the start, This is not your fault so you have nothing to worry about remember that and don't let it get on top of you,

    At the bottom of your letter once you have detailed what has happened be sure to add

    "Paypal are not a credit lending company of any sort and I have not signed any form of credit agreement with them, Paypal took it upon themselves to negative balance my paypal account of there own accord, This debt is in dispute with paypal"

    Please do not contact me again, Any form of contact from you either by letter or telephone may be classed as harassment and further steps will be taken if necessary.

    I just wanted to ask, Is it the buyer who's claiming his/her money back via paypal or is it paypal doing this so called claim because one of there system robots flagged this event,

    If its the buyer is he/she doing it as a chargeback with paypal?

    Also do you have proof of delivery of this item?

    Have you spoken to the buyer about this at all?

    hi, paypal took the money back due to the owner of the account saying after 28 days that a phone had been purchased on there account and the had notciced the money coming out of there bank account.

    i do have proof of delivery

    when i contact the buyer via ebay i get no response

Unfortunately, all you have is a proof of receipt for an address where any old joe might live. That may interest the police, but not paypal.

    It's possible that the paypal account was hacked, and you posted to the hacker. You wouldn't know either way.

    Personally, I'd be taking an keen interest in the address I posted the item to.

    Edit: refunded £515 for TV 1.5 years out of warranty - thank you Sale of Goods Act! :j

    Paypal have refunded the owner of the money - now you owe paypal. (At least that's how paypal see it)

    Whoever has the phone is the only one who's gained anything. At the moment, paypal are out of pocket, hence chasing you.
