Very good point. They just want it dealt with, with as little effort as possible. Funny when you’ve paid for it!D_P_Dance said:Why not write to the judge and explain to him that the consensus of opinion of most who have looked deeply into the issue is that mediation is NOT suitable in claims from the industry. The "other party" is trying to obtain monies by deceit, deception, threats and bullying.2 -
Is a judge not likely to ask why you didn’t bother to accept mediation?Le_Kirk said:We know mediation is a waste of time when the case has not been heard and the outcome of the case has not been decided and I think @Jenni_D has given you the forum's consensus on "on papers"!
I’ve received a court letter asking me to submit all documents and statements in a few weeks time to a particular email address. I have already send this a few weeks prior to the court and the claimant. Do I need to send it again to the email address they have given, or is sending it previously sufficient?0 -
"Sir (Madam), I felt that mediation was a pointless exercise given that the claimant was guaranteed to reject my drop-hands offer whereby they drop the claim and we walk away bearing our own costs, and I was guaranteed to reject any offer they were likely to make whereby I was required to pay them anything. i.e. there was no common ground to make mediation a worthwhile exercise".Olive_j said:

You need to follow the instructions from the court (and meet deadlines) so that you do not receive a default judgment. It is likely that the first set was when it would have been a F2F hearing and this is now going to be telephone or video hearing. Is it a court email address?Olive_j said:

@Le_Kirk there is no mention of it originally being F2F and now a phone hearing. It just says to ensure all documents have been sent to all parties by X date.
I’ve already sent everything on the advice from the forum when I was asked to submit the defence to the PCN when the CCJ was set aside. I’ve sent it to a different email to the one in the letter but they obviously received it to then suggest mediation.Maybe I’ll call the court in the morning and ask if I need to send again. I’ve already sent it to the claimant, don’t want to send it again if not needed.1 -
No, just forward the emails again with the hearing time/date and claim number, in the subject line.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

I’ve done that. Although don’t have a hearing day/time yet, just a deadline to submit by and that I “might” have the opportunity to have it seen on paper, which I’ll decline.Coupon-mad said:No, just forward the emails again with the hearing time/date and claim number, in the subject line.2 -
Is the court now asking you to submit your witness statement, even though you have already submitted it with your defence?2
-
Well it said ensure you have submitted all documents by x date. I’ve just forwarded to the email given to be on the safe side.ParkingMad said:Is the court now asking you to submit your witness statement, even though you have already submitted it with your defence?3
