Hi all, I’ve just checkede Experian and it says “satisfied judgment” for the VCS ccj. The parking company had agreed to wipe off the PCN if you remember, and agreed to the set aside. However a few weeks back after chasing the CCBC it transpired they hadn’t bothered to forward the set aside to my local court. Now I’m wondering whether a judge is going to be confused by the satisfied judgment, or whether they won’t see this information when they (hopefully!) agree to the set aside? For a split second I debated calling the CCBC but think it’s a waste of time and they won’t know what I’m talking about. My mortgage advisor has emailed to ask for an update as it’s time to renew. So frustrating as if the CCBC had actually done their job, a judge would have seen it several months back.

Hmmm, if you don't know if this has now (finally) been allocated to your local court then you'd have to ring the CCBC.

But I can't recall where you are at with this one.

Is it the one that the CCBC staff dealt with and no Judge even looked at it?  If so, it worries me that they might have only marked the CCJ as satisfied when the application and consent Order was for CCJ set aside, a completely different thing.

@Coupon-mad this is the one from a few weeks back when the CCBC said no one had looked at it with no apology, but that it was allocated that day. However I’m sure it was marked as satisfied a good while ago now, as I remember being advised on here to ask for the SAR from the CCBC and tell them I hadn’t paid which I did. I’m now wondering if that’s actually the reason why they didn’t process it when they should have.

Have you had an Order/Directions about this one?

It was a consented set aside and peel wiped the debt. Haven’t heard anything from the court.

I thought you had something from the CCBC saying a 'proper officer' had looked at the note... blah blah, or am I muddling your CCJ with another?

I do think you are going to have to ask the CCBC why you haven't had a Notice of Allocation because even a consented set aside needs a Judge to agree, and it shouldn't be just marked 'satisfied' because the point of the consent order is to wipe the CCJ.

@Coupon-mad I think it was marked as satisfied before I’d submitted the set aside, as I first contacted the land owner and they cancelled the parking charge. The CCBC said last week or the week before that it had been sent to my local court and would take 6-8 weeks. Do you usually get a letter from the court to say it has been received, or just once they’ve made a decision?

You should get a Notice of Allocation. Maybe wait till 1st Nov then follow up with you local court first to see if they got it.
