Hi thanks for that, at the moment there is only one case being heard, both claims were raised together, but one has got a general sanctions order on it ,on CCBC, as the claimant has not submitted a DQ. I have contacted CCBC saying they are overdue but not had a reply.
I am going to look at the order as previously advised above by coupon- mad and e mail them.

But then I have  received a letter from the claimant 2 days ago saying they have been informed it is a defended claim and that they will await a court date. (for the one in limbo), but still nothing has been uploaded on CCBC and they are 3 weeks over.

I was thinking of sending a copy of the claim that's in limbo  with the  one I have a date for as I wanted to inform the court of the other claim that was raised at the same time and what has happened to it.

At the time of starting all this there were 2 claims, and  submitted defences for both.  One has been given a court date the other just says it has a general sanctions order on it.   I had asked them to consolidate the 2 claims on my WS, but then this happened with the other one.

Was just hoping to sort both together and not go through all this again further down the line.

Mention the other claim (in limbo) in your WS and ask the court to consolidate them now into one hearing or to strike out the second claim for cause of action estoppel and failing to comply with an order.

If a claim has been struck out then that's it - it is dead (unless the C appeals the strike out order - unlikely).

As regards the "offer" ... hold fast; they're probably about to withdraw the claim. ;)
