So for the second one , email the defence , tonight , ASAP , then Keep checking your claim history , hoping it shows defence logged the week

If necessary , send both in , but deffo claim 2 defence asap if possible

Ask for claim consolidation in both

    Ignore the elms letter

From that it seems clear to me that there is not a Judgment against you.

The first claim seems to be all in order and as I wrote earlier, "...you have until 4pm on Monday 5th July 2021 to file your Defence".

However, with the second Claim the Acknowledgment of Service was filed late - the deadline for that was nineteen days from 2nd June. There is nothing to be gained by filing an Acknowledgment of Service after that nineteen day deadline.

You are now in a race.

If you file a Defence before the Claimant gets a Default Judgment against you then you go through to the next round.

If the Claimant seeks and obtains a Default Judgment before you get a Defence filed then it's game over - you lose.

Get that Defence filed before 8am tomorrow morning.

And of course as before, everywhere I have said 'you' I mean the named Defendant.

As you haven't told us, or shown us that letter in a readable format, it is difficult to comment on, but it would be interesting to find out exactly what it said.

Ah sorry, I missed that Dropbox link.

Having now looked at it, and seen your MCOL Claim History, it is clear that this sentence in that Elms letter is a downright lie...

Just to be sure, please check the claim number on that letter against your MCOL Claim History.

Perhaps Elms also failed to hit their submit button on 23rd June.   ;)

Hi no worries the date and claim number matches the one I didn't press continue, though you can clearly see from the print out that I was dealing with them both on the 7th. But my mistake for rushing and not checking, my home laptop had died and I had to do it on the works laptop as couldn't use phone.
Can I ask why we e mail to them and don't upload on the website where is says start defence ?
Do you think its worth e mailing the MCOL with the print out and explaining the mistake? thanks
