HEARING LOST in a PCN dispute

Many ThanksUmkomaas said:
While I can't guarantee it, the CEL MO is to pressurise you to jump through every hurdle placed in your way to defend the claim, meet all the deadlines and every court-required processes. Then, if you don't, they're in quickly for a judgment in default against you. If you do comply with all of that, they discontinue or don't pay the court fee by due date. I'd be surprised if this did actually get to a hearing. Stay with the plan.bergantet said:
Thank you for your opinion, we will see how all this ends. I think I'll have to wait for the hearing in the County Court and see what happens.Umkomaas said:The question is, is it enough for them to have photos of the vehicle going in and out? there is no barrier and they didn't show the car parked at allThat's all there ever is with an ANPR camera monitored car park, in and out.0 -
Hi all,
I hope you are doing well. It's been 2 months and I haven't heard from CEL or CBCC, I know they have up to 6 months, but I was wondering if it looks good or if it doesn't mean anything. Anyway, I'll try to keep you posted.0 -
I don't think it means anything.bergantet said:Hi all,

You will hear nothing more from the CCBC.
The hearing court will write to you when they allocate a date and time for the hearing.
Not sure what you are referring to when you say 'they have six months'.2 -
Anyway before any more advice, we need to know you have done the Government Consultation and sent an email to your MP, who might well be one of those who was involved in the 2018 debates:bergantet said:Hi all,

To be clear, we need individuals (you and your family and friends, separately) to do the consultation linked there AND we are now calling for everyone to ask their MPs to raise with the MHCLG, what the heck has gone wrong since March, that they now think it's OK for false debt recovery costs to be added that positively drive cases to court?
What are the MHCLG thinking? That added sum was supposed to end. The Knight Act included MPs unanimously condemning charges as high as £120, but this proposal takes it up to £200 and FUNDS THE ROBOCLAIM RACE TO COURT
We want MPs to kick up a stink.

Thanks for the explanation. When I said they have six months', I meant I believe the hearing court has up to 6 months to contact me about the hearing....KeithP said:

Best to assume that the nominated local court will contact you in due course , and not put any time limit on that action
Stick to facts , not assumptions 😋😋2 -
Just 3 weeks to do the Consultation. Don't miss it!PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Thank you, is there a template that I can use to write to the MP and how to respond to the Government Consultation? I do not want to make big mistakes that, instead of helping in this matter, would have the opposite effect.Coupon-mad said:

No there isn't; you need to read what we have said in each of the links and absolutely NO WAY should we be telling you what to put as a template! It needs to be your opinion, your words. Does that make sense why?
If you read the linked threads you will understand the problems with weighting the highest penalty against those victims who don't receive a PCN or miss the short window to appeal. That incentivises PCNs getting 'lost in the post'!
Also it's handing money to fund the race to court (what on earth are the MHCLG thinking) giving £70 per case to the likes of Gladstones who are being investigated by the SRA and who have a conflict of interests with the IPC Trade Body!
https://legalbeagles.info/forums/forum/legal-forums/motoring-parking/ppc-s-parking-charge-notices/ias/95073-all-change-at-gladstones-and-the-ipc
Same shareholders...same Directors in recent years as well.
And handing rogue DCAs £70 a pop instead of simply saying that the Single Appeals Service must be the 'safeguard' to prevent too many cases going to court, which should be re-offered as an ADR for 12 months (as the law on ADRs requires) is madness.PRIVATE 'PCN'?
