    Or, they could control their Agent - that they remain liable for, as the are the principal in this relationship -and order the claim discontinued

    Hi guys,
    so they decided to send me another court claim form now.



    So this one is for a different reg I had.
    Do I have to create a seperate acknowledgement account on the moneyclaim website or can I add it to the current account I have for the other claim form?

    btw both dcb legal/first parking llp and both same location.

    Do each separately , for now , so follow the same process on this new one as on the other one , but use the same login for MCOL , the account being your own , but wait until next Monday to do the AOS

    You can ask for the 2 claims to be consolidated at each stage , until a judge makes the order

    With a Claim Issue Date of 19th April, you have until Monday 10th May to file an Acknowledgment of Service. If possible, do not file an AoS before 24th April, but otherwise, there is nothing to be gained by delaying it. 
    To file an AoS, follow the guidance in the Dropbox file linked from the second post in the NEWBIES thread.

    Having filed an AoS in a timely manner, you have until 4pm on Monday 24th May 2021 to file your Defence.
    That's over four weeks away. Plenty of time to produce a Defence, but please don't leave it to the last minute.
    To create a Defence, and then file a Defence by email, look again at the second post on the NEWBIES thread - immediately following where you found the Acknowledgment of Service instructions.
    Don't miss the deadline for filing an Acknowledgment of Service, nor that for filing a Defence.

    Hi guys,
    So for the first claim I received the directions questionnaire a while ago I completed it and sent it off.
    Now for the second claim I followed the same steps I did for the first one however they never sent me a Directions Questionnaire for that one. This morning I received a Judgment for Claimant (In default) letter from the northampton court asking me to pay a large sum of money. It is clearly their fault for not sending me the stamped Directions Questionnaire.

    Is DCB Legal/First Parking just trying to be smart just to rob some money off me or has the court messed up by not sending me the questionnaire?

    What should I do now? Contact the court and tell them? Email or phone them? Or are there any other solutions for this?

    Any help will be appreciated.

    The DQ (N180) comes from Northampton CCBC, so yes, contact them (by phone) and ask when it was sent and to what address.

    Make a complaint to the CCBC that they didn't send you a DQ. 

    Seems to me the CCBC is messing up more often this Summer than we've seen before.

    Their phone lines hasn't worked properly in 2 days so I have decided to make a complaint online on the gov website. Quite straightforward online, made it clear I haven't received a directions questionnaire for the case which is unfair and also kindly asked them to put the case on hold.
    These parking companies are a headache for sure!

    If you don't hear back by Friday try ringing again.  Their phones do work usually but it takes ages to get through.

    I just looked at the POFA Explanatory Notes (part of the legislation):


    221.Paragraph 4 provides that the creditor has a right to recover unpaid parking charges from the keeper of the relevant vehicle if the conditions set out in paragraphs 5611 and 12 are satisfied. The creditor is not obliged to pursue unpaid parking charges through this scheme and may seek to do so through other means but they may not use the scheme provided for here to secure double recovery of unpaid parking charges (paragraph 4(6)), nor will they have the right to pursue the keeper, as opposed to the driver, of the vehicle where they have sufficient details of the driver’s identity. The right to reclaim unpaid parking charges from the vehicle keeper does not apply in cases where the vehicle has been stolen before it was parked, (paragraphs 4(2) to (3)), or in certain circumstances where the vehicle in question was a hire vehicle (paragraph 4(7)). The creditor may not make a claim against the keeper of a vehicle for more than the amount of the unpaid parking related charges as they stood when the notice to the driver was issued (paragraph 4(5)).
