  • Evening guys!
    Received the notice of allocation to the small claims track (hearing) letter today for the first claim. I have to submit a witness statement and all that stuff by the 4 October i think. Now, i'm confident I will win this case but once I do that how do I tell the judge to dismiss the other pending case too? It's a similar case anyway just a different case number.

    They have clearly admitted to being at fault which is fine but they're just going to take ages now.

    Will be really interested in the result as I am in exactly the same boat.  AoS filed on time (and logged in MCOL), no DQ received, defence submitted by email on time and then an out of the blue summary judgment for "Not replied to claim form", so far repeat sendings of the defence to ccbcaq have had no response either.

    Can I ask if you got the above customer service team reply from an email to ccbcaq or the direct phone call or the other gov online complaints form you mentioned?

    Hi, The email was from 'replies@optic.justice.gov.uk' HM Courts and Tribunals Service. I made a complaint online on the gov website.

    Thanks, I got a reasonably prompt response from HM Courts and Tribunals as well, my case is being referred to a judge for evaluation in the next 6 weeks apparently.

    Thanks for your response. I have a quick question before I send off the email to my local court. How can I mention Henderson vs Henderson in my email without sounding rude or very defensive. Can someone give me a typed up example, I just want to merge it in after saying that I want the court to 'consolidate both hearings together'.

    Just emailed my local county court asking them to consolidate both hearings together as instructed from you guys. Let's see what they've got to say. I have mentioned Henderson V Henderson too.

    Ok and when they ignore that, you repeat it again at every stage until the cases are consolidated, to avoid duplicate hearings.

  • Hi guys got some update.
    The court has sent me a letter yesterday saying that the first case has been set aside.

    I just got an email from the court again a few hours ago, i removed the case numbers and called them 1 & 2 just for the forum but here's the email i received:

    Dear Sir/Madam

    According to our records the case (case number 1) is listed for Trial on 2 November 2021 at 10:00 am at Willesden County Court.  The Judgment in case number (case number 2) was set aside on 18 September 2021 by the County Court Business Centre where the file is currently locates.    Please confirm, bearing this in mind, that you still wish to have the cases consolidated.


    Do I go ahead and tell to consolidate them or is there anything else I have to say due to the fact that the first case has been set aside? Thank you for your help guys!
