    Yes, as long as the second claim was not struck out after the CCJ was set aside, and remains live, you would want them both heard at a single hearing.  This is because they deal with duplicate facts and should have been a single claim (cause of action estoppel applies) and one hearing would save the court and yourself potential wasted costs and time.  Finish by asking for Directions for the cases because you will be needing to put in Witness statements and evidence shortly.

  • Just replied to the court telling them that I want both cases put into one hearing. 

    Got a letter today from dcblegal today regarding the first case, they sent me a copy of my defence and they told me to 'revisit the directions on the response pack as it was not correct to send a full defence to us'. Honestly no clue what they're trying to mean here.

    Now next step, Do I wait for a confirmation letter from the court or do I still treat the situation like I've got a hearing on the 2nd November? Do hearing dates changes when I consolidate cases together?

    They just mean you didn't have to send them a copy of the defence but we've decided to advise that recently, due to the CCBC failing email system causing CCJs for people.

    The hearing date might change, or it might not, who knows, that's why I said how to word your email to court the way I did, finishing by asking for clear Directions.  I hope you used my wording.

    I've emailed them as you've said. It's been close to a week now no reply from them.

    Quick question guys! I have to submit my witness statement and all that stuff by tomorrow 4th October, which I can even drop off to the court as they're local to me. Now the court hasn't replied back to me regarding the consolidation of hearings. Do I still submit my witness statement or wait until the court replies?

    Never miss a deadline , still ask for consolidation , at all times , even as. Preliminary matter on the day of the hearing

    Most courts now expect emailed documents , not paper bundles , so I am not sure why you are going old school with this , but its your choice !

    Do not forget to serve a copy of your WS bundle ( a bundle is the WS plus Exhibits plus summary costs assessment too ) to the claimants lawyer ( or the claimant if no lawyer is being used ) , so to both the court and also the claimant , by your deadline

    Thanks for your reply. I am going to get it all done today and get it e-mailed to the court and the claimant.

    Hi,
    Quick update. Received The Claimant's defence by e-mail and received the notice of hearing today from the court. I can confirm Cases have been consolidated into one hearing as stated on the notice I've received today. Hearing is on the 2nd November. Hope everything goes well.

    Hi guys, quick update.
    Received a chunky bundle of papers through the post today and it was from DCBL. They sent me their consolidated trial bundle including my bundle too at the end. Is this a new thing? I remember a few years ago it wasn't like this tbh.
