It's frustrating, when I decided to pay and then go to small claims court I was following advice from Citizens Advice:

It seemed a reliable source and it made sense to me at the time, but wish I had gone with the suggestions here instead.0 -
CAB are terrible, which is consistent advice on here
CABs script on parking matters was written for them by the BPA4 -
I have never seen one single case reported here of anyone following this ridiculous advice. Two separate court claims? The 'first claim' to agree that you parking ticket is unfair - are they serious? Then a 'second claim to decide how much the fine (sic) should have been'. This is just utter drivel.
Pay and make a small claim to get the money back
If you don’t want the parking company to take you to court, you should pay your parking ticket - this will stop the fine going up.
When you pay, you should say you’re ‘paying under protest’. It’s a good idea to put it in writing so you can keep a copy.
Then you can go to court and make a ‘small claim’ to try to get your money back - find out how to make a small claim.
You’ll have to pay a fee to make a small claim - you can find out how much the fee will be on GOV.UK. You might also have to pay court costs if you lose your case.
If you’re claiming because your parking ticket was unfair, you might have to make 2 separate claims. You’ll also have to pay 2 fees.
The first claim is to agree that your parking ticket is unfair. If the court agrees that it is, the parking company has to cancel the fine.
The second claim is to decide how much the fine should have been if it was fair. The court might decide that you still have to pay a fine, but it should be smaller.

At that moment I thought the suggestion by Citizens Advice was as valid as the suggestion given here. Their approach looked safer as a consumer and I was expecting Trading Standards to be knowledgeable in this area and aware of the problem with these PPCs. This is the main reason I took my decision.
I guess I can only say lesson learned.2 -
The problem with the PPCs is that people pay them, the problem is that the judges let them get away with abuse of process, wasting court time, and not punishing incompetent lawyers. You are in the position you are is because you ignored our advice.You never know how far you can go until you go too far.2

I am in this position because I didn't know that the advice offered by Citizens Advice is wrong, and how would I? This is the first time I face an abusive charge like this, and I'd always seen Citizens Advice as a reliable entity.2
