I posted a while ago about a Parking Eye case in Abersoch. That car park is well known for having non-compliant signage, and I took advice from here and contacted the landowner explaining that I had a disabled badge on display, and this was a genuine mistake. I responded to the case documentation from POPLA and Parking Eye as suggested, then the Landowner contacted Parking Eye telling them about the disabled badge, and I heard nothing further. I assumed that this case had been discontinued. However it seems DBCL are having a fundraising campaign and this weekend I received the following. I think from reading this thread I should just ignore it, there has not been a judgement made and the case has never been to a court.
Am I right? What will DBCL do next?0 -

Just another begging letter from DCBL adding fake amounts.
They quote the Beavis c Parking Eye case, how stupid is that ? The Supreme court ruled that the parking charge covered the costs of operating ... no fake add-ons like the £70
Anyway, Parking Eye do their own court claims that do not add fake amounts. If they did, they would go against their own case in the Supreme Court
By using a legal who adds fake amounts, it makes Parking Eye look very silly
Silly letters like this can be ignored

Excel v Wilkinson
At the Bradford County Court, District Judge Claire Jackson (now HHJ Jackson, a Specialist Civil Circuit Judge) decided to hear a 'test case' a few months ago, where £60 had been added to a parking charge despite Judges up and down the country repeatedly disallowing that sum and warning parking firms not to waste court time with such spurious claims. That case was Excel v Wilkinson: G4QZ465V, heard in July 2020 and leave to appeal was refused and that route was not pursued. The Judge concluded that such claims are proceedings with 'an improper collateral purpose'. This Judge - and others who have since copied her words and struck dozens of cases out in late 2020 and into 2021 - went into significant detail and concluded that parking operators (such as this Claimant) are seeking to circumvent CPR 27.14 as well as breaching the Consumer Rights Act 2015. DJ Hickinbottom has recently struck more cases out in that court area, stating: ''I find that striking out this claim is the only appropriate manner in which the disapproval of the court can be shown''.

I have received DCB Legal's letter of claim for a visit dating back to 2016. I have went thru newbies FAQ and requested SAR
As far as I understand, I will likely get a court hearing and I need to collect evidence via SAR request in order to better prepared for the argument
I dont own the vehicle anymore (sold 3 years back) and I dont remember who was using the vehicle at the time of incident. However, I ignored my previous letters as per advice in the forum elsewhere. My question is - mentioning about this will go against me ? thanks in advance

I really hope you and all posters and lurkers on this thread have done the Government Consultation - by email attaching evidence of what has happened to you - and objected absolutely to ANY debt recovery fake 'costs' being added on top of a parking charge (of course) and told them what you think of them increasing charges to £130 instead of £100...
You have 6 days to do the consultation. Please, please, do.
Also, I hope you've also registered for the Group Action, against the DVLA (open to anyone with a PCN since 2018?). Gotta be in it to win it! Nothing to lose, and it's genuine.
