Hello! I wrote in here a couple months ago now I think it was about PCNs from UKPC and DCBL LTD took over and kept sending letters etc. I’ve now had a letter through the post titled “Notice of Intended Legal Action, Unpaid Parking Charge of £170”. Is there anything I need to do with this or do I still just continue to ignore as I did with the rest? I am in Scotland and the tickets are also for in Scotland. Please note it does say at the bottom “This case is not subject to high court or bailiff action”. Also the car it’s for has not been owned by myself for over a year now. Thank you!0

But instead go and read the MHCLG Consultation thread as the new law will be mirrored in Scotland and this is your only chance to say what you think.
No link - go find it on page one - but all newbies need to go and read the thread and do the Government Consultation, ideally by email and taking time to add evidence of your case, debt demands and the general extortion of this industry.
Your Government is about to grant keeper liability, and if they also allow false debt recovery costs, God help your courts and people who drive because you are about to be the new targets for claims (currently rare).
Do an email with evidence, answer the questions and say what you think and make it clear you are in Scotland and find the combo of keeper liability and added false costs, nothing short of madness in Scotland and also breaches the new law they are introducing!

WHICH SEES THEM TRY TO CLAIM MORE THAN THE LAW ALLOWS, FROM A REGISTERED KEEPER,I just looked at the POFA Explanatory Notes (part of the legislation):221.Paragraph 4 provides that the creditor has a right to recover unpaid parking charges from the keeper of the relevant vehicle if the conditions set out in paragraphs 5, 6, 11 and 12 are satisfied. The creditor is not obliged to pursue unpaid parking charges through this scheme and may seek to do so through other means but they may not use the scheme provided for here to secure double recovery of unpaid parking charges (paragraph 4(6)), nor will they have the right to pursue the keeper, as opposed to the driver, of the vehicle where they have sufficient details of the driver’s identity. The right to reclaim unpaid parking charges from the vehicle keeper does not apply in cases where the vehicle has been stolen before it was parked, (paragraphs 4(2) to (3)), or in certain circumstances where the vehicle in question was a hire vehicle (paragraph 4(7)). A few months ago this company contacted me to say I owed then £420 for 3 parking tickets relating to a registration number being parked at Scunthorpe General Hospital.
The dates given are several years ago.
I have looked up the reg on line and it says it is a red Ford Focus.
I have never owned a red Ford Focus, Ora car with this registration number andI have never been to Scunthorpe.
They insist I contact them by phone, but having spent hours trying the number supplied I have not been able to get through.
Today I received a threat of court action.
Any advice?

Hi all. A bit of background. This ticket was received when my wife used a photocopied permit to park at her work, as instructed by her employer. They used the adjacent shopping centre car park. When she received the ticket she was told to just ignore it.
Fast forward 5 years and we receive our first debt recovery letter, followed by another, and eventually this last one which suggests that the client may take legal action against us!
Now I've read the stickies and intend to ignore the letters, but just wanted some reassurance that ignorance is indeed the correct course of action, as the letter obviously is intended to scare and it sort of works.

Same as all the DCB Limited cases here - keep the paperwork, but don't react to the demands.Don't ignore letters from DCB Legal - start a new thread of your own if you receive anything from these. Whether you will get anything from them is open to conjecture, only time will tell.Please note, we are not a legal advice forum. Obviously you'll have complained to the Retail Park with evidence of regular custom over the years for the family, and told them you plan to boycott the shops there in future if they fail to step in and cancel this horrific threat (you don;t have to show spending from that day 5 years ago nor mention why the car was there).
