Parking Fine in Edinburgh

Do not even communicate with them.

True, until the Transport Act is fully enacted because some idiots in Scotland actually decided to copy the (broken and anti-consumer) POFA 2012 Schedule 4 and bring 'keeper liability' North of the Border.  Stupid, stupid, stupid.  Here come the jumped up parking tickets and exaggerated court claims, Scotland:

    https://www.rac.co.uk/drive/news/motoring-news/private-parking-firms-issue-15-new-tickets-every-minute-research-reveals/

In 2012 when E&W was stupid enough to give 'keeper liability' to the parking industry because the BPA pushed for it and provided false figures (as they admitted later) there were less than fifty court claims per annum about scam private parking tickets.

There are now around 110,000 court claims p.a. in E&W so good luck coping with that sort of exponential explosion and consumer attack, Scotland.
Did anyone really expect the SNP to be intelligent?

Sturgeon got caught at a funeral and wake without her mask, outcome: a quiet word from a senior office from Police Scotland (provided they can prise such a person from observing Twitter).

A player from a Glasgow football club went to Spain back in the summer, told no one, didn't isolate when he came back, played in a game and started more cases, outcome: nothing (probably because said football club has money and can pull strings in Holyrood).

Scrapit, why have you dragged this thread off topic?
Questions needed asking, one of which is why is a newb reprimanding genuine users with genuine questions. I suspect an AE in breach of the rules, probably banned for good reason.
    And banned again!

Today I have received a 'Action Required Today' letter from TNC.
I have followed the advice to ignore the first letter.
Today's letter states as I have ignored and failure to act today will result in TNC seeking approval from client for passing account to a doorstep collection agent.
Points of note they added that the PCN followed a number of legal principles including
    • It was issued under the guiding principles of contract law as signs at the location offered the 'parking contract' and by remaining the motorist accepted their terms
    • The charge amount is in line with findings of the Supreme Court decision in the landmark Parking Eye vs Beavis case
    • Our client has followed all aspects of the British Parking Association Code of Practice
I would welcome thoughts on my next steps if any.

Yawn. Debt collector garbage. You know it is, because it is not a letter before claim. You know it isnt a LBC because you know what they look like, because the newbies thread tells you what to look out for.

Yes, a number of times to try to determine what to do. It is extensive covering all eventualities and left me indecisive to be honest. Because........
    • The fine is in Scotland
    • Unclear who the landowner is and so who to appeal to
    • Google can't fined the post code or the 'car park' name
    • Car registered in England
I suspect the recommendation is to ignore. Conundrum is that if a Debt Agent calls during working hours, it will be an 82 year old answering the door. But I guess that is how these letters work
Would you recommend a section I can focus in on?

Conundrum solved - there will be no call (during or after working hours)!
Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

Nobody will be calling , that's a foolish notion , fantasy land

Come back if you receive a genuine formal LBC , or a Court claim pack , or both l
These will arrive by post , not hand delivered

The debt collector stage is boring and irrelevant , Nobody cares about those worthless garbage letters !!

Debt collectors do not knock on doors , the post spam letters instead

I can think of better things to collect than doorsteps. Will these collectors have planning permission to remove your doorstep?
Will they post safety notices and nail your door shut so nobody can fall out, injure themselves, then sue the collection company for injury?
What if you have more than one doorstep? Which one will they collect?
What if you have steps, or don't have a doorstep because you live in a high-rise building?

Whatever is the collector going to do with your doorstep afterwards? They will need some heavy lifting gear to shift it, and need somewhere to store it. Perhaps that's what field agents do. Look after a field full of doorsteps after they have been collected.

People don't come round knocking,  Who on earth do you think this scum letter is from?  It's not a bailiff!  Why do people think this?

We have been banging on about this for over a decade.  Post #4 of the NEWBIES thread even shows you people's collections of such letters.  Yawn.
