    I am am of that.  IMO it t will do OP no harm to glance at it.  It may even encourage him/her to do further research on late payments.

    I used the Commercial Late Payments info in my reply to the MHCLG for the new PAS232, pointing out that if commercial (signed) debts can only add forty quid, yet consumer (unproven) debts are exempt from this legislation, the intentions of Parliament are crystal clear that you cannot apply a 'late payment charge' to a consumer (fake) debt.

    I did submit 30 pages, mind!  Pictures, footnotes, the lot.

    Late Payment Fee ... is that PPC World's latest wheeze to try and get around double recovery? So it's no longer a debt collection charge, it's a late payment fee. 🤣 (Which as mentioned above appears unlawful anyway).

    Please see reply to my latest missive asking them to explain the 'late payment fee'. Any advice gratefully received...

     

    Thank you for your email.  We would like to take this opportunity to draw your attention to the terms and conditions of use of the car park prominently displayed around the car park, by means of signage,  that states the following:

     

    Non-payment will result in a collection fee (for costs incurred as a result of debt and/or legal recovery) of £60 being added to the value of the parking charge."

     

    The signage in and around the car park formed a contract with the motorist and by entering or remaining on that land they agreed to be bound by the terms and conditions and as you have stated that you were the driver, this is contractually binding upon you.

     

    We, therefore, invite you to make payment at www.ridings-recoveries.co.uk/payments/.

    Did the signs in the car park really say that?

    Check the actual signs in your car park.

    Usually they do not specify the amount to be added.

    I would suggest that it makes quite a difference.

    Saying that "a sum will be added" without specifying that sum is so imprecise that it cannot form part of any contract.

    However, if a sum is stated, as described earlier, it could easily be argued that that was a valid term in the contract agreed between the motorist and the parking company.
