Hi all,
I've received today a Letter of Claim from dcblegal for a PCN from Bank Park Management.
Should I be actioning this letter?  I.e. Is this a Letter Before Claim (LBC) or different.
The letter sites a Pre-Action Protocol for Debt Claims which i can't see much mention of...
My first port of call to to review this with the land owner of the shopping centre and appeal for this to be closed down.
Any help would be appreciated!
Thanks
Andy

DCBL have become such a bore on here with their rubbish..  Not your fault by the way   No doubt DCBL are scamming you by adding a fake £60/£70
READ THIS and see what happens to legals who apply fakery

They have just be "fined" £10,000 for wrongdoings, read this

Nine times out of ten these tickets are scams, so consider complaining to your MP, sometimes it can lead to cancellation.,

You never know how far you can go until you go too far.
  • So what's the advice for my next course of action?
Am i right to appeal to landowner?

ALWAYS complain to the landowner , ALWAYS !!! Regardless

It is not an appeal , it's a complaint

An LoC or LBC is a letter before action from the claimant or their legal representative , giving 30 days notice and including financial forms

Anything else is a pointless debt collector letter , nothing of importance

You have not told us which it is , but the newbies FAQ sticky thread near the top of the forum has advice on both types

A court claim pack (MCOL) comes from the CCBC in Northampton , not from the claimant and not from dcbl either. The newbies FAQ sticky thread has advice in that stage too

Have you not read the newbies?

  • Hi guys/girls, yes i have scanned from the newbies but maybe i've missed the most relevant content, i'll go back there.
    @Redx
the letter from dcblegal is Letter of Claim, acting on behalf of Bank Park Management Ltd for unpaid PCN totalling £320 (2 occasions on same parking).
There are two pages, one "Information Sheet" with numbers and FAQs, and then the first page which is more specific.  No other documentation, only a "reply slip" at the bottom of the letter with the words "I request that a copy of the Reply Form and Financial Statement is sent to the following address:"

So what about the 2 items I mentioned that you haven't elaborated on ?

Did it give 30 days notice or 14 days notice ??

Did it include financial forms ?? Yes or no ?

These are not difficult questions to answer ?

To be totally clear , you still have not told us which it is !!
  • Apologies thought i had answered ref. the forms.
    • 30 days notice to pay or acknowledge the letter - failure to do so result in a claim etc.
    • Financial forms - No - only the slip as mentioned about request Reply Form/Financial Statement address.

Ok , due to the 30 days aspect , treat it as an LBC and do the 2 things required in that newbies thread

SAR to the DPO at Bank attaching a copy of the V5C as proof of I D under the GDPR law , plus reply to DCBL denying the alleged debt and telling them to place it on hold whilst you seek debt management advice , so same advice as in the dozens of similar threads on here

Then prepare for a court claim pack from the CCBC in Northampton , plus your SAR reply

That pre action protocol you mentioned has been discussed hundreds of times on this forum , possibly thousands of times , lol
  • Thanks @Redx
I've complained to the landowner and local MP regarding this (today) so hopefully that gets a positive response in the meantime.
I don't a V5C for my vehicle, its a business lease vehicle, so the liability for PCN etc is with me but i don't have V5C for it.
Should i do those two actions ahead of hearing back from the landowner?
Is the SAR and response to DCBL available as templates? Sorry i'm a bit useless finding things like that.
