hi, this is my first post and hoping to get some help with my cpw o2 contract cancellation.
I took out a 24 month contract with o2 through cpw which started back in january 2010 for £30/mth and I'm now 8 mths into the contract and wanting to cancel.
should I contact o2 directly for the pac our reference number and send the letter through to southampton? I have the address.
my main question is will I be required to pay a few of any sort too cancel this contract given that I have so long to go yet?

I would hazard a guess it's going to be quite a hefty fee to get out of that contract.
They may offer you a reduced tariff to lower your monthly rental etc.
Best bet is to give them a call first0 -

You have a 24 month contract, you are eight months in. At a guess they will not give you a PAC unless you pay off the contract, which is 16 months left at £30 - £480. I doubt that they will reduce your contract as you are not far enough in. Paying off £480 and then not getting the minutes/texts doesn't seem a good idea as you won't save any money and won't get the value of the contract.

I've been a CPW/o2 Customer for some years, usually getting quite expensive contracts £50pm etc and recieving higher end phones like the Sony Ericsson P800/900/P1i, Blackberry, etc.
The last phone I upgraded to was sold to me as a smart phone and it does indeed have symbian os, the Nokia 5800.
I was told by the phone sales person that I could have this at £20 per month. I asked if this included unlimited internet, as I would need that for emails on the go. The sales person said that this would be an extra £10 per month, so I agreed, the phone was delivered next day as expected.
Then my problems started.
I couldn't connect to any internet services at all with the settings sent by config sms, and let this slide for a while as I like to check the settings myself and put them in manually.
Still no luck, phoned Customer services a few times, they sent settings that never worked, loop, loop loop. As this went on for a while I was getting billed paperless for 3-4 months at around £50pm which I noticed when checking my bank account.
CPW refunded the overpayments and apologised, stating that they had not taken off the blackberry service and I was paying £3 Per MB. That was all fine, but still no Internet access.
Phone has been in repair for a firmware upgrade recently, but no joy, came back still not working.
Now, a year on, I ask them to sort this out or I want to end my (24 Month) contract early as I pay for a service that I am not being supplied, thus I assumed CPW were in breach of their contract.
Oh no. o2 say that as they supply my service correctly, they are not at fault, but blame the handset, saying that the handset is at fault, so I cannot claim that they have not given me my full, paid for service.
They also state that the internet is a 'free' addition to the £30 a month contract and that I have no reasons to complain that I cannot get it and expect a refund of all the £10 extras that I have paid to get the internet. This is an odd one, as I only asked for internet and was told I needed to pay £10 on top, the extra texts and mins added are useless to me, as I barely text or exceed 150 mins a month.
So now I am stuck with a phone for another 12 months that cannot work on the internet (the main reason for choosing these types of phone) or get my emails on the go (a major thing for me).
o2 have basically said that it's not their problem and that they are going to do nothing and CPW have said that they can repair again or send me new settings to the phone to get it to work (they sent them, and they still dont work).
What are my rights here, as o2 say that CPW's handset is at fault, and CPW just cant seem to fix this, but all the time I am paying for a service that I cannot use, but o2 says I dont pay as it's free, so I cant complain.

I also experienced problems with CPW. I've just approached the end of my 12 month contract with O2 via CPW, and then decided to get an upgrade, i.e., Blackberry Curve. I've negociated nicely the new contract and got the handset at home. I have inserted the old sim card into the phone, and realized the phone is faulty. I've tried to update the firmware and it was faulty. So after 1 day I decide to return the handset and also to cancel the upgrade (the contract). CPW told me they can replace the phone, but CAN NOT cancel the contract since I HAVE USED THE PHONE. Is that what they call "USE"? Just holding in my hand without using its functionalities? What can I do now to cancel it? What would you advice me?

I realise this post is quite old now, but I just wondered if you ever resolved this.
I have exactly the same problem, but with an iphone4. I've only had it 3 days - not made any calls or texts, but because I inserted the sim they say I cannot return it. I just want the whole thing cancelled. They told me when I ordered it on the phone that I could return it in 14 days, and didnt tell me I couldnt insert the sim, but are now saying i cant and am bound to a 2 year contract, even though i've only had it 3 days.
does anyone know what would happen if I cancelled my direct debit & just sent it back to them anyway?
any help would be much appreciated, as I otherwise I am stuck with a £40 contract for 2 years with a mobile that has no signal in my house!!0 -

Firstly, you wont just be able to return the phone and cancel the DD..... you are, like you said, bound to the contract.
There is a way of getting the contract to be cancelled. I remember the story last year of a chap who took Orange to court because he couldnt get signal at home. As far as I can remember, he got compensation for paying bills on a phone he couldnt use.
That would be the line I would go down. Telephone your provider/CPW and explain to them that the contract isnt any use. You may find this helpful to do this in writing. Give them the opportunity to resolve this issue before writing to them telling them you will be taking them to court.
A court threat usually gets things moving very quickly, as I have noticed with the likes of Orange and o20 -

i've already actually taken it into a carphone warehouse shop this morning, and asked someone there if i can cancel. they said yes, and cancelled it there and then. i gave him the sim & phone back which they scanned & cancelled on the spot. I asked if there would be a cancellation charge & he said no, as I hadn't actually made any calls or sent texts.
i'm hoping this will be the end of it. not convinced at all - but clinging to the fact that they happily took it back & cancelled it there and then.
have to wait and see i guess.0
