Just received this from Sara Roberts today. What exactly will happen now that LCPM have provided me with an SAR, although there still is no proof that the P&D machines were working.. The case is still with Gladstones and I’m not sure what needs to be done going forwards0 -
The SAR route is dead; you have no right to the machine logs using DPA2018
]You tell them you intend to make them prove that the machines were working, and you will require them to supply a full log of the transactions for that day, from every machine, to prove that all machines were functional.4 -
thanks, i’ll get an email sent over to LCPM now1

Response from LCPM, can anyone please advise?0 -
You've already been told ... THEY DO NOT HAVE TO GIVE YOU THIS DATA AS PART OF A SAR!
When it comes to the court claim itself (are we at that stage yet? This thread is too long - too much hand-holding) you will require them to prove that all machines were working correctly on the day.Jenni x3 -
Brushes aside your enquiry like removing a piece of fluff from their trousers/skirt! Let's see what they say when the judge asks why they did not provide the proof in court.2

I’ve not yet received a court claim Jenni - Just to be clear, should I basically wait to see if I receive a court claim in the next couple of weeks? Should I also send a response to LCPM or is there no need for this?0
-
Yes, as you have no abilitiy to do anything else right now.
Why respond? They told you not to4 -
As Le_Kirk says, it is for them to prove and if not, their claim is unreliable and they can look forward to a judge raising his eyes.
Anyways, Gladstones have added a fake amount and their only defence for this is nonsense
Don't forget this judgement ...... I'm sure Gladstones don't want to upset the court with time wasting claims ... again
EXCEL v WILKINSON ..... claim struck out for ABUSE OF PROCESS. DDJ Jackson who is now HHJ Jackson made this ruling.
