Had requested an redacted copy of Land Owner Agreement, which PP refused to provide (expected). PP Ltd are now passing my case to their solicitors, so case of wait and see. No response from landowner to my letter. Should I make a SAR ?0

They will have to produce it to the court anyway. The parking companies are desperate for cash right now, as are the dodgy legals. The daft legal will immediately taint their claim by adding £60 which is unlawful and abuse of process. They have run out of their feeble excuses for the add-on so now they pretend the Code of Practice gives them the authority. SAR now makes sense. Means you have everything in place BEFORE a court claim pops up.2

Just to help manage expectations, a SAR will not produce the landowner agreement. Only your personal data that's held and for that of your vehicle. A landowner agreement won't be produced unless/until it gets to court, and then its likely to be heavily redacted and provided only at the last minute. Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

Is it acceptable to a supply a heavily redacted copy of a contract to a court? How does D know that it does not conceal material facts?.You never know how far you can go until you go too far.0

Probably not, but it's the way it is in many parking cases. From court reports, Judges appear not to be too exercised.D_P_Dance said:Is it acceptable to a supply a heavily redacted copy of a contract to a court?

You need ot go through and highlight any redacted areas that could be hiding something key - such as landowner cancelaliton clauses, scope of their contra,t and so on.1

Thank you all for your posts. As a complete novice in terms of contract law, I do understand D_P_Dance's comment above, i.e. how can one highlight areas , if the landowner contract is not seen.nosferatu1001 said:You need ot go through and highlight any redacted areas that could be hiding something key - such as landowner cancelaliton clauses, scope of their contra,t and so on.0 -
As long as you aver that the scammers have no standing to issue charges, you will get to see the alleged contract at the exhibits stage of a court case.
Quite often these contracts are with an agent, not the landowner, so you need to determine who actually owns the land. Have you been able to determine that yet.

Youve been told when you will get to see a likely-redacted copy. You do the above careful examination once you have the contract in your possession....x2y2 said:
