    I think if you were driving and recall the event, as it seems, then remove the template #17 and spread what you've put between a new #17 and #18.

  • Recieved a without prejudice offer from VCS offering a reduced charge of £125 pursuant to the civil procedure rules, are they having a laugh? should I respond / am I required to respond pursuant to civil procedure rules?
    I'm just sitting down to look at completing my DQ and will respond to VCS now should I need to.
  • Thinking of sending this as a reply to their offer, thoughts?


    Dear Sir / Madam 
    Thank you for your letter with your reduced offer of £125.
    I reject your offer but pursuant to the Civil procedure rules, insofar as litigants are expected to try and resolve their disputes wherever possible, I am willing to not pursue my costs in this matter should you drop all claims within the next 14 days from the date of this letter.
    This offer is made on a "without prejudice" basis.
    Should you fail to accept this offer of settlement then I will claim for my full costs and bring this letter to the courts attention upon the question of costs.

    I wouldn't put "without prejudice" on anything. Without prejudice and without prejudice save as to costs are not the same thing.
    I would just make the drop hands offer and not mention WP at all. 
    Other opinions are available.

    Ok thanks for that guys was just trying to be clever using their own terminology back at them, guess trying to be clever when you've no idea what a phrase legally means isnt the best of ideas lol hence why I asked here first  ;)
  • Update....its been a while!
    Today I recieved a letter Notice of Allocation to the small claims track, it states that due to a signifiant backlog of small claims due to covid a new system has been put into place.
    Nearly all small claims will now be listed for a 30 minute telephone hearing (called a dispute resolution hearing) in a 2-3 hour window when you must be available. to be heard by a district or deputy district judge.
    If you don't take or miss the call the judge may strike out the claim or defence!
    So it seems I wont actually be going to court after all has anyone any experience with these phone hearings? using BT meet Me
    I will attach photos of the letter shortly.
