Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

Umkomaas  yes my bad and it would have been easier but I had already done it and circumstances just didnt allow me the time to mess about with it any more. I cant turn the clock back but Coupon-mad hasnt dismissed it as a pile of nonsense so I feel ok with that. Thanks.

Coupon-mad  thank you. I'm not sure what you mean by  ' draft order '  to try persuade a judge to just strike the claim out ?  Thanks.

You need to read the Telephone Hearings thread, then you understand about the draft order.  Since everyone seems to have trouble using the search facility, read this thread in its entirety: -

I have a letter of acknowledgement from CCBC dated 11 April for my letter of defence but up to now no DQ from them.
I realise the current situation will affect things , such as delayed post etc , but is there a timeframe for this please ? I am aware there will be a date for which it has to be returned but I dont want to be just waiting for it to come through the post if I should chase it up.
    Many thanks.

The DQ is only sent out once the claimant confirms theyre proceeding with the claim. They have 28 days to do so. MCOL will tell you when the DQ is being sent out.
You could do the obvious thing of downloading your own version - as the nebwies thread tells you.

Thank you. I got a letter from Gladstones dated 14th April -

We act for the claimant and have notified the court of the claimants intention to proceed with the claim. Pls find enclosed a copy of the claimants completed DQ which has also been filed with the court.
You will note the claimant has elected to mediate in an attempt settle this matter amicably,  without the need for further court intervention.  Should you agree to mediation, pls inform the court who will contact both parties to arrange a mediation appmnt.

So I would read that as they've  told the court to go ahead but then say we give you the chance to mediate to sort and we wont go to court ??  ( I will refuse mediation as per advice given thanks )

I realise they send this as scare tactics but I didnt want to just wait for my DQ if there are deadlines etc etc. Thanks.

Have you checked it? It will tell you if the DQ has been sent out.
Thats their completely standard letter, you must have seen it on dozens of threads now?
